A new Fiction 49-77.1 is .hereby added to Chapter 19 of the 23 Hermosa Beach City Code, to read as follows: 24 "Section 19-77.1. JOINT MEETING WITH IMPROVEMENT COMMISSION - 6:30 p.m. Present: Councilmen Valdes, Wise. Mayor Thelen, (Councilmen Belasco and Valentine entered this meeting at 7 p.m.) Improvement Commissioners Hankins, Martinez, Murray, Ryan, Young, Chairman Bergstrom. During the informal discussion regarding what has been done by the Improvement Commission during its first year as an official body and projects recommended by the City Council for future projects , the Commission was congratulated for its initiative and for having stimulated several events that unified community interest, and for bringing more residents and businessmen into participation in city government. The members of the Council agreed that both physical improvement and an added dimension to citizen participation were important aspects of Improvement Commission activities, and that they felt the members of the Commission should continue to recommend to the Council any and all types of projects which they felt would improve both the physical and life style of their community. Projects recommended for their further consideration during the discussion included fostering a spirit of togetherness in improving entire neighborhoods on a citizen - participation basis; improvement of city -owned properties; underground utilities; making Pacific Coast Highway a more attractive area; continued efforts to develop the very successful test trash program; and sponsorship of art shows and image development, Adjourning the joint meeting at 7:30 p. Cri. , Mayor Thelen expressed the Council's appreciation to the Commissioners for this discussion, and suggested that additional joint meetings be held in the future from time to time. HERMOSA BEAUTIFUL MONTH - Mayor Thelen invited Improvement Commissioner Betty Ryan, Chairman of the Youth Projects Committee, to present Certificates of Appreciation for their contributions toward the beautification of the City of Hermosa Beach to Girl Scout Troop #474, North School Conservation Group, Patanka Camp Fire Girls, and Circle K International, El Camino College, and the Councilmen added their personal thanks for the fine efforts of these young people not only during Hermosa Beautiful Month in March, 1970, but throughout the year as well. N. S. 154, SECTION 801 - LIMITATIONS ON PERMITTED USES IN C-1 C-2 AND C-3 ZONES - Planning Commission Resolution P.C. 154-768, adopted March 2, 1970. DISCUSSION - The public hearing was declared open by Mayor Thelen, and at his request City Planner Crawford summarized the proposed amendment which included a conditional use permit requirement for entertainment in C-2 and C-3 Zones, and excluded entertain- ment from C-1 Zones. He added that three ordinances now existing regarding the same matters had been combined, with superfluous items eliminated in order to clarify the provisions of this section. As no one in the audience wished to be heard regarding this matter, the public hearing was then closed and the title of the proposed ordinance read aloud by the City Clerk. ACTION - to waive further reading. Motion by Councilman Valdes - Second by Mayor Thelen, Carried, Ayes: Councilmen Belasco, Valdes, Valentine, Wise, Mayor Thelen, Noes: None Absent: None FURTHER ACTION - to introduce Ordinance No. N. S. 382, entitled: "AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING ZONING ORDINANCE NO. N. S. 154, AS AMENDED, BY DELETING SECTION 801 AND REPLACING IT WITH A REVISED SECTION 801, "LIMITATIONS ON PERMITTED USES IN C-1, C-2 AND C-3 ZONES." Noes: None Absent: None NON -AGENDA ITEMS - CITY COUNCIL Tribute to City Councilman Jack T. Belasco - Mayor Thelen presented this City's Plaque of Appreciation to Councilman Belasco, commenting that he had been elected to the City Council on March 10, 1959 and had been reelected in 1962 and 1966 by citizens who appreciated his dedication to the community. The Council then presented a floral tribute to Mrs. Evelyn Belasco for her eleven years of generous cooperation and participation in her husband's service to the City of Hermosa Beach. Municipal Pier ACTION - to replace the benches at the head of the Municipal Pier as set forth in the original plans approved by the City Council as soon as possible following their repair. Hermosa Bowl Area - Valley Park - Letter from Mrs. Gordon Evans, Civic Beautification Chairman, Hermosa Garden Club, Post Office Box 155, Hermosa Beach. DISCUSSION - City Manager McDaniel displayed for those present a conceptual plan presented to the City by Miss Agnes Laufer, student of Graduate Environmental Design, University of California at Los Angeles for the use of the Park and Recreation Commission while developing a definitive plan for Valley Park improvement to present to the City Council for consideration, and also outlined the City's intent to fill in the sump area and the problems caused by the cost of purchasing and importing appropriate fill, Mrs. Gordon Evans was present to represent the Garden Club, and was joined by Mrs, Frances Young in expressing dissatisfaction with the delays that had prevented the completion of the bowl concept. Mrs. Harold Dillon offered some advice regarding possible free fill, and Councilman Wise suggested that the City advertise for contributions of free fill from construction projects in the surrounding communities. -3- Minutes 4/7/70 AL: � r.' Hermosa Bowl Area -Valley Park (Continued) ACTION -- to direct the Director of Public Works to place advertisements in the news media indicating that this City has a drop zone at Valley Park sump. Motion by Councilman Wise - Second by Mayor Thelen. So ordered,. Customer Parking Problem - Letter dated April 2, 1970, from Mr. Paul Matthies, Hermosa Swim/Gym, 939 Pier Avenue. DISCUSSIOI\T -- Mr, Paul Matthies spoke to the Council regarding his desire to enlarge the facilities of his establishment at 939 Pier Avenue and the customer parking problems that would be caused by the Los Angeles County funded improvement and widening project on Pier Avenue, requesting that the Council endorse the original ten -spaced parking facility that it had recommended when he went into business in 1959. City Manager McDaniel, City Planner Crawford and Mr. Stevens, Director of Public Works, outlined for the Council the potential traffic hazards that might result from continuing an .eighty -foot driveway cut rather than following the standard practice of not more than thirty feet, and explained the new configuration of curb and sidewalk called for by County specifications. Councilman Valdes stated that he sympathized with Mr. Matthies' desire for as much customer parking as possible, but felt that this matter should be taken to the Planning Commission with a request for a Conditional Use Permit so that a complete study could be made before a decision was handed down. Mr.. Robert E. English, 315 Pier Avenue, requested that the 'City Attorney determine whether it would be constitutional to turn property into nonconforming use, and was directed by the Council to search out this question. Mayor Thelen stated that he had noted no traffic problem when backing out of the parking lot under discussion., and Councilman Wise expressed the opinion that the Council should encourage the improvement and expansion of business enterprises in this area. Councilman Belasco felt that the safety of the general public should be considered. ACTION - to approve the original ten -spaced parking facility for 939 Pier Avenue as recommended for this property in 1959. Motion by Mayor Thelen.-- Second by Councilman Wise.. Carried. Ayes: Councilmen Valdes, Valentine, Wise, Mayor Thelen. Noes: Councilman Belasco: Absent: None Possible False Arrest -- Telegram dated April 1, 1970, from Mr. William A. Cloud, 531 Pier Avenue. DISCUSSION - Mr. Cloud was present and requested an opportunity to discuss with the Chief of Police and the City Council this City's policy regarding the narcotics problem of young people in the community. ACTION - to refer the request of Mr. Cloud to the City staff and direct that a meeting be arranged with the City Manager and the Chief of Police for a discussion and clarification of this matter. Motion by Mayor Thelen - Second by Councilman Wise. So ordered. Dog Problem - Mrs, Inez Russell, 1633 Raymond Avenue. ACTION - to receive and file. DISCUSSION - Mr. Sniffen was present and requested that the Council consider waiving the $50 fee normally required for a public hearing regarding a request for a variance, as the six foot fence for which this variance was required due to a misunderstanding regarding the minimum height had cost him more than that amount. During the discussion that followed, the Council suggested to Mr. Trott, Director of Building and Safety, that the Board of Zoning Adjustment consider modifying the fee for variance application in certain cases, and was advised by Mr. Trott to place this matter before the Planning Commission for their consideration. ACTION - to grant a waiver of the $50 fee for his application of variance for a six foot fence located on property at 662 1/2 Longfellow Avenue.. Councilman Valentine also suggested that a $10 parking fine be requested, and Mayor Thelen requested that further consideration be given to this facet of the recreational parking policy. Councilman Valdes suggested that the Council might also pursue the possibility of establishing a joint parking area with the County, for the use of weekend visitors.. McDaniel, City Manager SUBJECT: Taco Bill Status Report Gentlemen: In the opinion of the Police Department, the adverse conditions have been very substantially relieved since this action arose. Officer Finley has continued his effective patrol efforts, and the owners have made a sincere and effective operational change. Last week, as directed, Chief Berlin, Officer Finley, and I met with the Grills and reviewed all aspects of the question. It was our feel- ing that they now recognize their responsibilities and are serious about further cooperation. Pertinent elements of the problem are these: anaaes meat; Competent management is now on the premises, and will continue to be at all times—either Mr. or Mrs. Grill, their daughter (age 27), or Mary Hernandez, age 32. The person in charge is actively controlling loitering, behavior, illicit activities, and turning away undesired customers. Hours: Hours have been reduced to 11:00 a. m. to 7;30 p. rn. , and no later, including weekends. These hours will be maintained during the summer as well. Personnel: More stringent hiring checks have been instituted, and employees receive more direct supervision. (Actually, they have had trouble finding employees, even at a $2.00 per hour wage.) Pricing; Similar to Taco Belle, a rule has been enforced prohibiting the purchase of beverages only after dark, and a 50$ minimum established. The family trade is on the increase. Interior: The single most important change was removal of the jukebox. Restrooms have been closed. New signs regarding behavior and loiter- ing have been posted. The Grills have agreed to experiment with a new customer traffic pattern, using the center Pier Avenue door, to eliminate the sidewalk waiting line. Page 2 Outsides Officer Pinley has been actively keeping groups moving° and preventing a build-up on the sidewalk. We are putting a bike rack on the south pier head side, to eliminate their parking against the Taco Bill wall. Were now working with the Grills to obtain a refuse bin in back, eliminating the sidewalk barrels. B COMMENDATION It Is our finding that the situation has now been relieved and stabilized, arnci we feel reasonably confident that this will continue. Attorney informed Mr. Grill had he had a right to have Legal representation at this hearing if he so desired. Mr. Grill stated that he did not require;n attorney, and waived a reading of the charges that were being brought against him regarding difficulties caused by individuals within and around his premises. Mr. William Q. Grill then stated that he and his family had lived at 925 Eighth Street for the last ten years, and that his restaurant w :e owned by himself and his wife, Irene Grill. In reply to questions from the Council, he outlin<r° the steps that had been taken to prevent loitering on his premises, stating that he had put up "No Loitering" signs, lockad the public restroom, taken out the jukebox, -End was closing at 8:30 or 9 p.m. rather than at midnight. He also informed the Council that he and his wife were trying to spend as much time as possible in th•. restaurant in order to supervise the conduct of business, and added that he felt that the Police Department was performing a fine service for the down- town area with their foot patrol. At the invitation of Mayor Thelen, Mr. Grill also set forth his own suggestions for alleviating the problems in the downtown area caused by locations where unproductive groups of people congregated for long periods of time. Councilman Wise, sp-.king for the Council, assured Mr. Grill that he had been asked to come before the Council not because he was being blamed, as an individual, for the problems in the downtown area, but because the Council had in its possession specific information relatingtto activities in his establishment that had been called to Council's attention by concerned citizens, and it w s hoped that with his cooperation the steps necessary to alleviate this problem could be initiated. During the discussion that followed, the Council suggested various methods which might help to control problem activities, such as hiring a full-time experienced adult to be present in the dining room area, to have waitresses serving in the dining area rather than cafeteria style food service, and having the City provide full-time walking patrol throughout the lower Pier Avenue area. Councilman Wise pointed out the need for closing the public restrooms south of the Pier as early as possible, and Councilman Valdes expressed his belief that as much money should be spent by the City on a program of counseling and other efforts to prevent the spread of drug addiction as is now spent to stop it after it has started. With the consent of the Chief of Police, Councilman Valentine questioned Police Officer Donald Finley regarding his observations and activity report with regard to drug activities in the subject area and the number of arrests for narcotic violations and traffic. Chief Berlin also answered questions from Mr. Valentine regarding law enforcement procedures to locate and single out specific areas when they became sources of drug and narcotic traffic. Councilman Valentine then stated that he f, It that the Council would be remiss in its obligations to the community if Mr. Grill were not urged to do everything possible to protect both the community and himself, and suggested that he be invited to sit fin. with,. the Chief of Police to discuss some kind of internal control for his establishment that would not be prohibitive in cost. -1- Minutes 3/17/70 Councilman Belasco pointed out that past experience indicated that moving drug traffic away from Mr. Grill's establishment would merely move the market place to another location in the same area, and suggested that every businessman on lower Pier Avenue should be included in these discussions and requested to give full cooperation to the City in an effort to clear the entire area rather than concentrating on removing this problem from one specific location. Mrs. Fred Webb, 1750 Manhattan Avenue stated that she felt this problem was not the responsibility of one man or one business establishment, but was something that was borne by all, adding that anything the City government and stores could do to upgrade that area would be good for the entire city. Mr. John Wiley, 211 South Francisca, Redondo Beach, and owner of income property in this city, suggested that businessmen in the problem area pay a percentage of their sales tax income for privately employed security officers on a constant basis. Councilman Wise stated that he commended Police Chief Berlin and Officer Finley for the fine work they were doing in the area under discussion, and presented to the City Clerk a petition requesting that the foot patrol be sustained and signed by 90 residents and .:businessmen in downtown Hermosa Be.: ch. and Councilman Belasco expressed his opinion that no business should put the burden of sharing the disproportionate cost for extra police patrol in this area on the rest of the City , adding that ha favored the suggestion thet merchants finance a private patrol system. In reply to a question from Councilman Valentine, Mr. Grill stated that he would be more than willing to meet with the City Manager and the Chief of Police to develop a program designed to solve the current problems under discussion. ACTION - to continue this public hearing to April 21, 1970, and to direct the City Manager and the Chief of Police to meet with Mr. Grill, inviting Mr. Grill to report back to this Council on the date set in order to mke a progress report. Dear Sirs: 62 Strand Hermosa Beach, Calif April 12, 1970 In noting the articles recently regarding the rest room shortage in our City, we have always objected to the idea of large facilities placed adjacent to single family residences, however, on a recent trip to Lake Isabella, the army seem to have found a compatible solution to the problem. They use a fiber glass telephone booth type of facility with aircraft equipment (a pump -out and or a filtered system) such as monornatic. This type of installation could be placed next to the lifeguard towers, away from residences and if necessary bolted to a. concrete pad to prevent vandalism. Since these facilities are only large enough for one person it would eliminate problems with deviates, etc. I would suggest you have someone visit Lake Isabella and see how this problem is solved at a reservoir used for both recreation and as a source of domestic water. This type of installation could be in operation within 30 days. Bergman, Administrative Assistant SUBJECT: Recreational Parking Zone --Differential Fine Gentlemen: We have been investigating the feasibility of establishing a recreational parking zone similar to that of Newport Beach. Essentially their approach provides for higher "over time" fines for parking meter violation within the zone --now at $10.00. Our current fine is $2.00. Essentially our approach was to broaden the general concept of a fine dif- ferential and apply it to all parking infractions within our recreational zone. It has ,generally been the notion of the Council that such a zone would include Hermosa Avenue and all of the area west thereof, except the downtown. We are -.currently preparing the necessary ordinances and resolutions to implement this program. The material will be available Tuesday evening. A number of policy questions exist in defining the "downtown area" and pro- viding for some special situations in our proposed recreational zone. Downtown Area: 1. Area between the north lane of 10th Street and the south line of 14th Street. (essentially the V.P.1).)., or 2. Between the south line of 8th Street and the north line of 16th Street. (that area not serviced by parking medians). Special Situations 1. Inclusion or exclusion of the area north of Greenwich Village. 2. The small commercial areas at a) 2nd Street b) 22nd Street c) Greenwich Village area. Page 2 The following are some alternatives in dealing with the question of seasonal exclusion: 1. No seasonal distinction (effective all year). 2. Summer only (6/1 to 10/31) . 3. Easter through summer (3/15 to 10/3 1) . 4. Easter and summer (3/15 to 4/30 and 6/1 to 10/31). The choices presented are not exhaustive as the alternatives could be infinite. The amount: of existing or proposed off-street parking facilities, a.nd their distance from the proposed establishment. • • (3) Location of and distance to churches, schools, hospitals and public playgrounds in relation to the proposed establishment. (4) Hours of operation of the proposed establishment. (5) The combination of uses proposed within the proposed establishment. (6) Precautions taken by the owner or operator of the proposed establishment to assure the compatibility of the use with surrounding areas. (7) The relation of the proposed business to traffic volume and the size of streets servicing the area; routes of ingress and egress and their potential effect upon street and pedestrian traffic. (8) The proposed exterior signs and decor of the proposed establishment which are planned to advertise the activity, and the compatibility thereof with existing establishments in the area. (9) The number of similar establishments or uses within close proximity to the proposed estabUshment. (10) Such other considerations as, in the Judgment of the Planning Commission, are necessary to assure that the purpose and intent of this provision are upheld. (C) Nonconformance of Existing Uses -- Limitation to Conditional Use Permits. (1) All existing uses of establishments for which there exists no valid Conditional Use Permit as provided for in subsection 801(A) above are hereby declared nonconforming uses and are governed by all applicable provisions of Article 13 of this ordinance. (a) Any Conditional Use Permit issued pursuant to the provisions of this section shalt terminate and cease to apply to any establishment or use which has been vacated or discontinued for ninety (90) days or more. (b) If such nonconforming establishment or use is vacated or discontinued for ninety (90) or more calendar days, any future use which requires a Conditional Use Permit as provided for under this section shall require a new Conditional Use Permit to be processed in the manner specified in Article 14 of this -4- (2) • ordinance a rid V,/ h /Oh has been granted and is effective, prior to reinsi:ating said nonconforming use. McDaniel, City Manager SUBJECT: Pier Avenue Status. Gentlemen; For City Council information?, we should point out two steps taken this week as the street job nears completion. 1. The Chamber of Commerce, acting on an urgent request by down- town businessmen, is asking for temporar continuation of the west- bound twin movement around the north side of Greenwood Park. This would be one way only, making use of the street which otherwise would simply be shut off. They ;rade clear that this request was only until the Bacon property is developed (frankly, we're very optimistic on an early favorable decision by Albertsons to be the prime developer). At that time, it would be abandoned and the right turn pocket at the southwest corner used. After reviewing the physical plans, John Stevens and 1 agreed that such a temporary use would not be detrimental. Time is of the essence, since the curb work will be poured by the Council meeting. Therefore, T gave approval to the idea, and the County has been asked to accommodate the change. Council ratification of this decision is requested. 2. We have had some continued discussions with Paul Matthies over his driveway issue, as the safety hazard becomes very clear on an 80' drive cut. Various compromise proposals have been advanced, some involving /trailed time curb parking. Obviously, an optimistic prediction of Planning Commission or City Council action on his Conditional Use Permit new constriction request is needed—and we gave it. (Incidentally, the City Yard has been given Number One priority on the staff five year capital improvement projects report, to be released within two weeks.) 2. The city property list has been roughed out and is now being put in a useful form for Council and commissions, and will be sent by next meeting.
