Mirassou, City Attorney In response to your correspondence of May 8, 1970, concerning the above -entitled matter, .it is my opinion that because of the fact that the Improvement Commission is a recommending body only which in essence could be terminated by the City Council at any time, the formal rules regarding Commission appointments are of no real necessity in this matter. However, I do agree with you that there should be some action by the Council Council so as to alleviate any future ambiguity. Therefore, it is my conclusion that the City Council may, based upon a mistake of fact concerning when the Commissioner's terms were to expire, (a) rescind the Commission reappointments.made on December 2,',1969, and•make these reappointments in December, 1970'as suggested.in your°correspondence; or, (b) the City Council may acknowledge the facts set forth in your correspondence and reconfirm the appointments.. Edgerton, City Clerk SUBJECT: Improvement Commission -- Terms of Office Due to an error on the part of this office, the names of Improvement Commissioners Kathy Bergstrom, Don Murray and Barbara Darden were presented to your honorable body in December, 1969, as part of a reminder list regarding City Commission terms about to expire, and were listed as serving terms expiring December 31, 1969 rather than December 31, 1970 as was the case. These three Commissioners were subsequently reappointed to full four-year terms to expire December 31, 1973. Since that time Barbara Darden has resigned, and Mr, Hank Doerfling was appointed to serve out her unexpired term; now listed as expiring December 31, 1973.. Under the terms of Resolution No. N. S. 2816, the term; of Commissioners Bergstrom and Murray and of Commissioner Doerfli6g should be expiring, after reappointment, on December 31, 1974 In order to avoid the loss of one year of their term due to having been reappointed one year early, I would respectfully suggest that the City Council rescind the reappointments of Commissioners Bergstrom, Darden and Murray,. made on December 2, 1969, and allow me to present the names of Commissioners Bergstrom,. Doerfling and Murray to the Council for reconsideration upon the original expiration of their first appoint- ments to office, in December, 1970. We wish to express our thanks to Commissioner Betty Ryan for bringing this matter to our attention. At the two meetings held (May 13 and May18, 1970) the bodies discussed the purpose and effect of the Commission's recommendations. During the dis- cussion, some members of the Board 'of Appeals exprgased doubt that the city • could legislate in this direction. The Planning Commtssto still feels that while the proposed 600 sq. ft. is a good minimum Awe for a one bedroom apartment, it is not a good minimum pyre for a two bedroom apartment, and that the argument that larger apartments attract unmarried non -family group living is contrary to the evidence of recently - built smaller -size unit developments. Through our discussion with the Board of Appeals, it appeared to be the general consensus of opinion that it is feasible to lift the existing height limit under a precise plan. The Planning Commission do;;,s not wish to prevent any upgrading of the development regulations, therefore: We recommend: 3. That Ordinance ON. B. 380 be adopted; 2. That it be recognized that Ordinance N. S. 380 is but a step in a con- tinuing effort to improve the living environment of the city; and 3. August 9, /1968 This legislation implies that roadside rests shall become part of the highway right of way and be operated and maintained by the State, with such facilities as they (the State) deem necessary. If this is the intent of the Council's resolution, such action would seemto be contrary to the best interests of the community. Paragraph 1.55 of the Streets and Highways Code provides for special interest • stopping places. This legislation.would permit the city to retain ownership, and allows the State to advertise the site 'in various manners. Perhaps the Garden Club should be asked to explain their proposal in greater depth. Hermosa Nueva '73 Hermosa Nueva 7), the second open house to be held at City Hall, is to be Sunday, June 7, from 4-7 p.m. Invitations designed by Comm. Tanner and Purpus, have been mailed and distributed through the schools and additional publicity will appear on the city sign and in the news media. The Police Dept.. Fire Dept. and City Hall Offices will be open for visitors during the event, with staff members present to answer questions. Refreshments will be served in the City Hall patio and motion pictures produced by the Pier Avenue Junior High School Enrichment Group will be shown in the Council Chamber. An interesting slide show, prepared by our own Police Dept. will be shown in the new facility, located in the basement. Councilmen are encouraged to save the date and plan to do the honors with the public in the new Council Office from 4-7 p.m. Schedules can be arranged between the five of you so that no one has to remain during the entire afternoon, unless he desires to do so. 2. Vetter Windmill Dedication The dedication ceremony for the Vetter Windmill is scheduled to be held in Greenwood Park on Friday, June 19 at 11:30 a.m. Special plans to include an old fashioned picnic and vintage motor car parade are near completion. The American Postal Corporation is an Ohio Company --to date only doing business in Southern California. As you know from the previous report, they are involved in the delivery of third class type mailings (so-called junk mail). To date they have invested well in excess of $250,000 in the formation bnd operation of this venture. (22mation Using a large force of permanent part-time carriers (local residents, mini- mum age - 18), route supervisors, field managers, and field coordinators, the Company begins delivery of material about 8:00 a. in. By attaching the material to the door knob, using a special plastic pouch (available for your inspection) the materizil is distributed without much possibility of becoming windblown lettere. For your information the Company carries $500,000 of general Iieeility insurance. Leggeali.ty. As you know, at present we do not provide for this type of operation. And thusly, this becomes your primary question. If you wish to co tinue the present policy, the proper action would be to receive and file Mr. Packard's letter and this accompanying report. However, if you wish to alter the city's posture, we have prepared the necessary instruments. Contention If we wish to previde for this operation, the question of licensing rears its head. Our current licensing code does not provide a. practical means of set- ting a license fee—consequently new sections are necessary. And heee's where the controversy begins. The licensing department believes the opera- tion is no different than any other "walking service" and should be licensed accordingly (generally in other cities - $6.00/day/person with a maximum of $30/day). American Postal Corporation believes they are a diff rent animal • Page 2 and fall within a distinctly separate class and should be charged an annual license fee comparable to other cities, ranging from $25.00 to $150/year). The same question has arisen in some Orange County cities a and their Coun- cils have concurred with American Postal. The argument advanced by our license department is that the firm in essence distributes the same material to the same locations as a "walking service" and is hiding behind the name "postal". The counter argument advanced by American Postal is that a walking service does not have documented routes which are repetitively traversed by regular erapIoyees--as does American Postal. Finally, they believe the per diem basis of licensing is economi- cally prohibitive and essentially is a means of disallowing such activity. The question of fee is really a judgment matter and has been left to your discretion. The alternative to the per diem fee is a fiat annual rate which we propose at $150.00. (I have checked with the Company and they have agreed to this figure). Discussion It is quite obvious that this type of activity will require a great deal of regulation. Consequently, we feel that a franchise agreement would be much preferable than additions to our licensing code sections because it • enables us to package a number of requirements and provisions into a sin- gle document/agreement. I have contacted American Postal and they have agreed in principle to all sections of the proposed agreement. I might add at this point that experience in other cities indicates that once permission is granted to one company, several others usually follow suit three to six months down the road,, e beliwe that this would present no significant problem if each additional company were to have similar franchise agreements. If this service is permitted in the city, the city could realize a significant savings by using the firm's services for our own local ,mailings. Rates Generally the rates range f, depending on quantity) between 1-1/3 to 1-3/4 cents per piece less than the United States Post Office. Assuming the city used this service for the delivery of the Newsletter, we would realize a sav- ings of $67.00 per mailing—or $270.00 per year. This coupled with the elimin- ation of the addressing process (approximately $50.00/mailing) means an annual benefit to the city of $470.00; plus of cours0 any license fee. U.S. 2848 making a finding that a petition for the installation of a sewer system in the easterly portions of 7th and 8th Streets was signed by more than 60% of the affocted property owners. Also •at this meeting, the Council directed the City Engineer to prepare plans© profiles, etc.0 and authorized the City Manager to negotiate terms of agreement for services of a special counsel, assessment engineer and necessary design eng- ineer. During the past year, this office has been working on the develop- ment of the plans and specifications, The Council has approved the employment of South Bay Engineering Corporation for engineering services, Laurence a. Thompson, Inc. for assessment services and PIO MeNenzie Brown as Special Counsel. one of the pclolems involved in the furnishing of a sewage collec- tion facility In this area is the at that the subject portions of the two streets involved slope away from the remaining area •and the rest of the City sewer system Since the streets slope toward Redondo Beach, it vas deemed most feasible to attempt to tie the new sewer /ines into Rondo's existing system. The alternative to this was to construct a special pump, station to lift the sewage westerly over the hill and connect to Hermosa's existing sever system, •Considerdble time has been spent in analyzing these two alternates and in negotiating an agreement with Redondo Death for using their facilities in the case of the first option. In 1968, the United States Congress passed the Federal -Aid Highway Act of 1968 which, among other things o provided for the allocation of federal fund to states tor traffic oper- ations improvementS in urban aneas, The program under which the new funds were to he allocated was called TOPICS which is the acronym for Traffic Operations Program to Increase Capacity and Safety. In 19690 Sate Senate Bill 1028 was passed which provided for the implementation of the TOPICS program by establishing a general frame work within which administration of the program was to proceed from the State level to the local levels. The Federal funds available to the State were to be apportioned to Local agencies for expenditure within urban areas© In addition to having to be expended in urban •areas, these funds must also be expended for a special type of project designed to improve traffic capacity and safety as determined by a local agencrs traffic oriented studies, The projects also have to be located on certain selected streets Imam as a P-2 system. The dbjeative of the program is to encourage more efficient and safer use of the existing street system by the systematic application of traffic engineering measures and control de- vices. The TOPICS program is agt a construction program but is a program involving the use of such measures and devices to solve congestion and safety problems rather than turning to costly road widening projects. Examples of sone of these measures might be: Additional parking restrictions: One-way streets; Special turn lanes at intersections; widening of road ways at intersections: increasing curb return radii; install- ation of traffic signals; channelisation of intersections; . grading highway safety sightings etc, The cost of eligible projects is to be shared between the Federal Goverment and the local agencies on a 71.3% to 28,7% basis with the local agency share being the lesser amount. Existing state gas tax allocations can be used by cities and counties to fund their 23,7% share, A prerequisite to the actual implementation or construction of a TOPICS project is a study and analysis of existing traffic operations characteristics. This appears to be a reasondble cloice and is favored :by many of the communities in Los Angeles County. John SQ _ S:tevens�t ,g , Public Works When the 1965-70 street lighting assessment was made to the property owners of the city, a fairly heavy assessment was levied on the property fronting Hermosa Avenue from the south city limits to the north city limits. This increased charge was due mainly to the costof constructing the proposed median lighting s y tea and the increased ener i cost for the up- graded lighting. At the time ,the engineer ` s report for the 1965-70 as <essement program was isAde, the cost of the new Hermosa Avenue install- ation was stimated to be $35,000. Since the Di s trict did • not have sufficient balance fund , to pay for the new system, the city planned to advancethe necessary funds and be rem payed by the District over the ensuing 5 year period Thus the residents were to receive their upgraded lighting ystem at the beginning of the new ass A semont period and they could enjoy the increased 114hting w til a paying their assessments For numerous reasons, the construction program, was delayed till the end of the five-year period. By this time, the project cost had increased to $490000. With the addition of extra work, the total project cost amounted to $53,796.00. Although the cont was almost $19,000 higher than anticipated, the District had sufficient funder to cover it because of under expendAtute on incidental expenses during th 5 -year period and the existence of a canting ncy fund. It is felt, however, that therexists a certain inequity to the assess- ment payers in that they were being asensed for energy charges required for the new lighting, while they were in actuality rec= iving benefitsonly of the old lighting system. Some consideration should be made in the new assessment esnt spread to compensate for the overcharge during the past 5 -years and the increased project cost by reason of construc- tion dela. It is suggested that the sum of $11,024.00 be charged against our State Gas Tax Fund (2106) and that the Lighting Di trict account be reimbursed by the same amount. This sum is the computed cost of the light standards and fixtures located at major intersections and areas of particular hazard along Hermosa Avenue which is a Select System Street. These spots are; South end of median at Lyndon, Second Street, Eighth Street, Sixteenth Street, Twenty-second. Street, Greenwich Vill .ge, and the north and of the magi -an at Twenty-seventh Street. WHEREAS, the Board of Zoning Adjustment, after hearing duly and regularly held as provided by law, did in B.Z.A. Resolution 154-18, dated April 27, 1970, deny the request of Douglas O. Sniffen for a zoning variance which would permit the erection of a six foot fence in a front yard set -back of ten feet in lieu of the required maximum height of three feet permitted in said setback, on property located at 66211 Longfellow Avenue; and • WHEREAS, pursuant to the terms and provisions of Zoning. Ordinance No. N. S. 154, as amended, Douglas O. Sniffen has taken his appeal from the determination and action of the Board of Zoning Adjustment, as set forth in said resolution, to the City Council; and WHEREAS, duly noticed public hearing concerning this matter was set in City Council Chamber on the 19th day of May, 1970, and the appellant, Douglas O. Sniffen being present and oral and documentary evidence having been presented and each member of the City Council having before him all material presented to the Board of Zoning Adjustment, and it being determined that no further evidence was desired to be presented by the appellant and the CoUncil being fully informed on all matters and the public hearing closed, the City Council did unanimously direct the City Attorney to prepare a formal resolution setting forth that the findings of the Board of Zoning Adjustment were upheld, NOW, LuEREFORE, THE CITY COUNCIL OP THE CITY OF HERMOSA BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the members of this Council do hereby concur with the findings of the Board of Zoning Adjustment, as set forth below: 1. There are no exceptional or extraordinary circumstances or conditions applicable to the property involved. 2. The granting of this variance would be giving the applicant special privileges not shared by other property in the immediate vicinity. 3. The granting of this variance would be materially detrimental to the public welfare and injurious to the property and improvements in the immediate vicinity of said property. /4 • SECTION 2. That said application by Douglas O. Sniffen for a variance permitting erection of a six foot high fence in lieu of the required maximum height of three feet on property located at 6621/2 Longfellow Avenue in the City of Hermosa Beach is hereby denied.
