Berlin, Chief of Police SUBJECT: Change in Manpower Distribution Sir: This morning, I provided your office with a copy of scheduled manpower distribution effective 2300 hours, 30 June, '70. This schedule will reduce the compensatory time earned by all personnel that are assigned to the 4 on 2 off shifts. In other words, all uniformed officers, with the exception of Utility, Traffic and Parking, will no longer' earn the,7 Jars and 20 min- utes given to members of the police department in lieu of the holidays granted City employees. Further, I will attempt to arrange that all other members of the staff take off the day of the holiday, in order to avoid the build-up of compensatory time off. The schedule of uniform personnel will provide the maxi- mum amount of available manpower to all shifts under normal operating conditions. However, any sickness, injury or attempt to reduce compensatory time off due personnel willput the shift or shifts affected below what I feel is an effective working unit in the field. You will note that we have structured into the schedule one person to act as a .vacation relief, which. will allow one. per- son to be off of his assigned shift for the period of his. vacation, but it makes no allowance for two people in the uniform forces to be off on vacation at or near the same time. We have also built in a ranking officer, Sergeant or above to be present dur- ing the work a day week as well as weekends. This of course, June:30, 1970 Wesley C. McDaniel, City Manager Page 2. Re: Change in Manpower Distribution is not a fact since Lt. Stonier is listed on the schedule, but is not presently able to perform these duties due to • a job in- ' curred injury; and his date of return to full duty is not known to this office. In addition, if a Sergeant or Lieutenant 'is ill or off duty for any reason not planned, we will not have a responsible ranking officer on duty in the station or in the field, but some officer of rank will be available for telephone consulta- tion and decisions if necessary. McDaniel, City Manager SUBJECT: Item 12 - Business Establishment Litter Control Gentlemen: At the last Council meeting, 1 was'asked to report this time on the annually moulting problein of take-out establishment litter control. Please consider this to be a preliminary report on the eubject. The possible solutions aren't new (except for one); we've been through them before. In each, though, two problems cop up: a) In terms of. technique, the norma1 solution would be to cite . violators.. However, the sheer size 6k the problem, and prosecution difficulties, makes this im.practical. The alternative then is to. charge for cleenup...ebut the problem here is that a set charge, without flexibility, gives no incentive for the establishraent to do its own work. b) Legally, the City Attorney feels that our potential tools are weak. A prime question in his ©pinion that litter off -property, even if identifiably from a given .premise, is in a separate category of much more dubious status. The alternatives, and comments, include: 1. Cite. As noted, normally the clearest. But... who°s at fault - the customer or the business? 'VVho cites? The enforcement problem would be overcome by the volume. 2. Clean and Bill This was my original approach: simply to clean up, repeatedly if necessary, with city forces and bill the establishment the cost plus overhead. However, the City Attorney finds no legal way to do so, unless the establishment voluntarily consents. 3 Nuisance Action This probably could work, but it is long and involved, and fails to meet the continuing need. It°s better used in one-shot special cases. 4„ Business License Override California law allows for a "Business Promotion Tax,” as a percentage override of the business license, which could be used for this purpose. This technique is a possibility. But all businesses would have to be included (in the area), with reasonable varying rates attached. The question of private v0 public property arises. And the incentive factor is lost; there is no way to refund or otherwise alter the amount. 5. Business Pemit Dejposit A suggestion is to require, as a business permit condition, a cleanup deposit; if cleaning then were done by the city, a charge would be made. However, the business permit statute itself is tenuous, and the City Attorney again feels that the deposit - and means of collecting on it - must be agreed to by the operator. Also, this 1:.,chnique fails to attack existing non -conforming businesses, which don't require a permit. 6. Sanitation Charm This is a new one, and maybe the best; it is obviously directly related. It has been proposed that, with the needed increase in the refuse -sanitation billing caused by our new contract, we extend the sanitation f,sewer, street cleaning, related cleaning) charge to business establishments (not now charged). in. this case, perhaps we could set a different charge on take-out places, and perhaps it could vary as needed. We intend to take a quick, close look at 46 above, and report back on it immediately. Otherwise, 42 or *4 offer the best choice. Respectfully submitte eylu z -pe 'WESLEY O. ROSECRANS AVENUE LAWNDALE, CALIFORNIA 90260 AREA CODE 213 679-0661 CARL B.TERRANO PRESIDENT The matter of the proposed rezoning of the Fucile property on 21st Street has come to my attention, and I am at a loss to understand the actions of the Planning Commission regarding it. I am the owner of property in downtown Hermosa Beach and I have followed the development of the General Plan with interest. According to this plan the Fucile property can be developed as an apartment site. In the absence of such a plan, the potential zoning, the nature of the surrounding properties, and the physical status of this property make it clear to me that it is suitable for an apartment house. Having had some experience in planning matters in an adjoining city, in my opinion this property is not suited for commercial development and it is very badly situated for the building of single family homes. It is almost inconceivable that anyone would buy a new home directly across the street from a large apartment house. An apartment house on this site with two parking stalls for each unit would not be detrimental to the area or the light traffic on 21st Street nor disturb the residential neighborhood further down the street. The replacement of three old houses would be an asset, as would the increased tax base. To deny this use would be more than an injustice to the owner . It would create an unfavorable climate for the continuing development that Hermosa Beach Must have if it is to overcome its problems. Very truly yours, Carl B. Terrano gatIlb JUL .yip CITY CLERK HERMOSA BEACH Cu July 60 1970 TO: Honorable Mayor and City Council FROM: Wesley Co McDaniel, City Manager SUBJECT: Item 11 - South Ardmore Parking Study Gentlemen: We were instructed at the last meeting to prepare a survey of parking problems on Ardmore south of Pier Avenue to the city limits, reporting at this meeting. It was our understand- ing that this survey would include reference both to the num- bers of parked cars which hinder vehicular traffic, and conversely to the degree of inconvenience which would be experienced by abutting property owners should parking be prohibited. It had been our intention to assign this question primarily to the Police Department for preparation of a report including both vehicle counts and visual representation of parking problems. Unfortunately, the recent intensity of police activity has ffirced us to forego this study date, nor have we been able to divert non- polic.v personnel to the task. It is requested that the City Council postpone the reporting date on this question for two additional meetings, which should give us adequate time to complete the task. From successive informal visual analysis of the street, it appears that the numbers of parked cars are great enough to hinder vehicular traffic significantly, but are few enough in number and localized to particular residences as to cause inconvenience to only approxi- mately ten premises should parking be prohibited. McDa City Manager SUBJECT,: Emergency Preparednesa Drills Since the bomb scare drill held recently under Police Department auspices, involving test placements of dummy bombs throughout the City Hall complex, I have had some opportunity to consider the effectiveness and procedures involved in this type of activity. Needless to say, the drill obviously demonstrated OUT vulnerability, but this was reasonably well known before hand. The same question continues concerning the.proper equation of cocked doors and other reasonable Security measures measured against the cost and philosophy ©f turning the premises into a serni-fortress. A brief report from the Fire Departnient has been furnished to me, but I have not yet had the opportUnitv to review the evaluation report from the Police Department, which I understand is still in preparation. • Undoubtedly we can learn much from these types of 'drills, and by proper evaluation take measures to 'increase our security Within reasonable limits. However, I am concerned over the 'potential real haard to life or property should a true emergency arise during such a drill, iivhen the command, officers o the affected ciepartments are not aware of the circumstances net are other techniques employed to provide for iMinediate cessation of the drill and emergency response if necessary. I believe that it should be the 15blicy in any future drill activity that the Chiefs and necessary command officers of any department affected, as well as myself, be brought into the picture during the planning stage0. and that absolute procedures allowing for the immediate release of emergency equipriaent in the event of a real life situation be made a part of the drill plan. This meeting was adjourned to a personnel session at 7:13 p.m. and reconvened by Mayor Thelen at 830 p.m. PARKS AND RECREATION DEPATTWE T BUDGET After reviewing the budget of the Parks and Recreation Department, Councilman Wise reques;:ed that consideration he given to a night volley ball program to be held on the beach and that lighting be installed to accomodate the program. Councilman Bigo voiced his opinion as being in favor of decreasing the budget for the Parks and Recreation Department and Councilman Valdes proposed that an additional sum of $2,000 be added to the Parke and Rec- reation budget for use in developing a daytime recreational program to be held on the beach. This proposal was agreeable to the other members of the Council and the City Manager was authorized to amend the budget accordingly. Mr. Orval Gertsch, 1124 19th Street and Mr. Ed MoDziugall, 2464 Silverstrand, members of the Hermosa Beach Baseball League Boar& spoke to the Council about additional funding for their organization for the coming year- The City Manager explained to the Council that he could not recommend granting additional funds to the Base- ball League and the Council directed the City Manager to meet with members of the Baseball Board to assist them in finding satisfactory solutions to their prdblems. During the discussion of the 1970-71 Preliminary Be the Council heard from the following members of the audience: Mmes. Lagan, Jr. to the Board of Zoning Adjustments. 1970-71 PRELIMINARY BUDGET The City Council reviewed the budget of the Building and Safety Department and requested that the City Manager amend the budget to include the purchase of a four drawer legal filing cabinet for use in the Building Department, Next the Council discussed the budget of the Fire Department and requested that the City Manager investigate those cities which operate under a PUblic Safety Department and report back to them. Aiso they requested that the City Manager bring the Council up to date on the status of Civil Service Commission rules and regulations revision. Councilman Valdes recommended that the budget of the Fire Department be approved and the other members of the Council concurred, At this point the City Council invited Mr. George Hall, Manager of the Cbamber of Comffierce to come forward for a discussion of the City's Promotional Bvdget. Mr. Hall presented to the Council the Policy Statement of the Hermosa Beach ChaMber of Commerce and Plan of Action for the Fiscal Year 1970-71 for their consideration. TYpon inquiry from the chamber representatives who were present, the Councilmen unanimously agreed that the direction they wished to see the Chamber of Commerce take was toward the business community, to become more business oriented and to promote the business community by stimulating business interests. Mr. Cyril Brookes, past President of the Chamber, informed the Council that the Chamber intended to advertise nationally for a Chamber of Commerce Manager. A committee consisting of two members of the Chamber Board of Directors, two members of the • City Council, and the City Manager, was approved by the Council for screening of the chamber of Commerce Manager applicants. Councilman Bigo and Mayor Thelen were appointed to serve on this committee. City Manager, Wesley McDaniel presented a memorandum to the Council recommending a budget allocation for the Chamber of Commerce promotional effort for the year 1970-71 in the amount of $25,760. Funds available from the Advertising Music and Parks revenue and the Fireworks Revenue. The City Council accepted the recommendation of the aty Manager and agreed that this budget allocation should be continued for a period of two years with regular review of the Chamber program to allow the Chamber to retain a more highly paid. Each Councilman was invited to discuss any addition or deletion that he wished to have considered before the final adoption of the budget, and any changes would then be incorporated in the final budget presentation to the City Council. City Manager, Wesley McDaniel, then reported to the Council on hts meet- ing with representatives from the Hermosa Beach Baseball League Board. A letter from M. Paul Matthies, Chairman of the Parks and Recreation Commis- sion, was presented requesting that the City Council notify the Commission of any changes in policy which would result in the Baseball league Board reporting directly to the Council rather than continuing to wok through the Commission. The City Manager suggested that this request Was in order and the Council agreed. On the motion of Councilman Valdes, seconded by Councilman Wise, it was agreed that the arnount.of $4,1000 appropriated for the Baseball League Board in the Park and Recreation Commission budget would remain at that amount for the time being. Due to the hour,. it was agreed that discussion of further changes in the budget of the Department of Public Works would be held over for the next stu.dy session. All data starts as of 0001 hours 1 July 70, and for the purpose of the reporting period, the majority of data stops as of 1000 hours 6 July 70. Our preliminary report to you dated 1 July 70, reflected planning, selection of personnel, identification of probleins, setting of goals, etc. We, at that time, pointed out that this opera- tion was still lacking a written directive from your office, but that we had proceeded to place "Hermosa Beautification" into action. - Overtime hours are reflected in daily work sheets from each of the teams involved; the work sheets also reveal the areas of concentration and the types of arrests being made in those areas. However, a total of 311 hours of overtime, above our scheduled use of personnel, has already been expended during the first few days of this operation. The statistical reports reflect what has been accomplished by the entire department, and not just what the team efforts have produced, although the specific information can be obtained by glean- ing work sheets for each of the teams. It should also, be noted that our jail facilities would not ac- comthodate the numbers of persons held in custody and that it has been necessary to utilize Manhattan Beach Police. Classification of Positions. (a) An annual review shall be conducted each spring to determine a proper position classification plan for the City. A schedule of approved classes shall be included in the annual Classification and Salary Resolution, adopted coincident with the annual City Budget. (b) The classification of positions may hereafter be amended by the addition, division, consolidation or abolishment of classes by resolution of the City Council. SECTION 3. Allocation of Positions . The City Manager is responsible for each. position being allocated to its appropriate class on the basis of duties and responsibilities . SECTION 4. Use of Class Titles. The title of the class to which any position is allocated shall be used in all official personnel records and in all official personnel -transactions of the City of Hermosa Beach. This section shall not be construed in any way as a limitation on the use of working titles for any position in the City Service. SECTION 5. Compensation Plan. (a) The five-step schematic schedule of salary ranges and steps listed below, as Schedule I, constitutes the compensation plan applicable to classes of positiorns included under Schedule III, the Schematic List of Classes. (b) All salaries prescribed are monthly rates. In those positions where it is more appropriate to pay upon an hourly or daily basis, the hourly and daily rates shall be determined by the following formula: 40 hour week is equivalent to 173.333 hours a month; Daily rates are equivalent to the appropriate hourly rates multiplied by 8 hours. (c) The compensation of employees shall be as set forth in the schematic list of class titles and salary ranges as shown in Schedule III or on the flat rate or hourly basis set forth for the classes listed under Schedule II, the. Table of Hourly Equivalents. SECTION 6. Exem t Service. The following officials and employees are hereby exempt from the provisions of the classification plan, except that provisions of Sections 8, 18, 19, 20, 21, 22, 23 and 24* shall apply to all full-time positions: (a) City Clerk (b) City Attorney (c) City Treasurer (d) Mayor (e) Councilmen (f) City Manager *8.- Administration of Compensation Plan 18 - Vacations 19 - Holidays 20 -- Sick Leave 21 -- Incompatible Activities 22 - Personnel Records 23 - Military Leave 24 - Definition of Terms The compensations for the above-mentioned positions are hereby fixed as the amounts determined by the City Council at the time of adoption of this resolution. SECTION 7. Limited Service. The compensation of Limited Service Employees of the City of Hermosa Beach shall be set as amounts determined by the City Council. SECTION 8. Administration of the Compensation Plan. (a) Normally, and as a general rule, employees may be considered eligible for increase in salary acording to the following general plan: (1) The letters A,B,C,D, and E, respectively, denote the various steps in the pay range. (2) Salary step "A" will be paid upon initial employment for a period of six months, which period shall be considered the employee's probationary period. (3) Salary "B" will be paid upon completion of six months of -2- employment where the employee has demonstrated satisfactory job progress and normally increasing productivity. (4) Salary "C" will be paid upon completion of one year of employment in salary step "B" where the employee has demonstrated satisfactory job progress and normally increasing productivity. (5) Salary "D" may be paid upon completion of one year of employment in salary step "C" where the employee has convincingly demonstrated job progress and productivity which are above the average for the class. (6) Salary "E" may be paid upon completion of one year of employment in salary step "D" where the employee has convincingly demonstrated job progress and productivity which are substantially above average for the class. (b) In any case where by reason of unusual circumstances rigid adherence to the foregoing principles related to salary adjustment would cause manifest injustice, the City Manager may make such order relating thereto as in his discretion is proper, excepting for matters pertaining to the City Manager position. (c) Initial employment at salary step "B" or "C" may be authorized by the City Manager when a particularly difficult recruiting problem is found to exist, or on the basis that a candidate possesses outstanding job qualifications. SECTION 9. Application of Compensation Plan to Positions . The salary schedule for the respective classes of positions as set forth in Schedules I and II such amendments as may be adopted by the City Council from time to time shall have the force and effect and shall be interpreted as follows: . (a) The salaries or rates of compensation prescribed are fixed on the basis of full-time service in full-time positions unless otherwise designated. (b) The rates of pay prescribed shall be deemed to include payment for all the services performed in any manner in the job description. (c) Where a salary range for a given class or for several classes is hereafter revised upward, the incumbents of positions in classes affected shall have their existing salary adjusted to the same relative step in the new salary range unless otherwise provided in Schedule III. If in allocating any incumbents to a salary range for the incumbent's classi- fication or revised classification, there results a salary range lower than that to which his class has previously been assigned, the incumbent shall retain his previous range hereinabove provided for the class. VOLUNTEER AND AUXILIARY FIREMEN Volunteer and Auxiliary Firemen shall be compensated for organized drills at the rate of $5.00 per each 2 -hour drill session. Compensation shall not be made for attendance at meetings other than for drill purposes. Volunteer Firemen called in for response at the scenes of fires shall be paid $3.00 for the call in, which payment shall include their compensation for the first hour of service, and each hour there- after shall be compensated at the hourly equivalent, based upon a forty hour week, of the base starting pay for the position of Fireman. Auxiliary Firemen, when called in for response at the scene of fires when not on active duty with their department, shall be compensated on the same basis as Vol- unteer Firemen. When responding to fires during their normal duty hours within their respective departments, they shall receive no additional compensation for their fire service. Volunteer and Auxiliary Firemen when called to "sleep -in" at the station, shall receive total compensation in -the amount of $5.00 for the "sleep -in" time, and if required to respond to a fire call while on "sleep -in" duty, shall be paid the hourly equivalent, based on a forty hour week, of the base starting rate for the position of -5- 4, R3. 0o.tutinn. zre , N . b EXHIBIT A Fireman, for those hours of tines apen't on the fire call. For the purposes of determin- ing the number of hours for Volunteer and Auxiliary. Firemen, fractional time shall be reported to the nearest one-half hour. POLICE RESERVE Called in to serve in lieu of regular personnel or to supplement regular Police Department personnel, Police Reserve shall be paid $3.00 per hour. POLICE MATRON Person called in at unusual hour to serve as matron while females are in cus- tody shall be paid $2.50 per hour. COURT TIME Every Police Department employee appearing in court on official city business during a time other than his normal working shift shall be paid his normal hourly equivalent rate with a minimum of three hours for each half-day appearance, regard- less of actual time spent. This provision shall be administered by appropriate detailed departmental rules, approved by the City Manager. LONGEVITY PAY In addition to the basic salary steps for each salary range, employees accruing a total of seven or more years full-time service shall be paid a salary equivalent to one full 5% salary step above his base salary step, provided, however, this provision shall not apply to elective officials nor to any employee or officer who is directly appointed by the City Council. In addition to the "seven year longevity pay" described above, employees accruing a total of fourteen or more years full-time service shall be paid an additional • y r, Resolution No. N. S. EXHIBIT A 2-1/2% salary step above the combination of base salary and "seven year longevity", provided, however, this provision shall not apply to electiveofficials, employees or officers directly appointed by the City Council, and all sworn police personnel. EDUCATIONAL INCENTIVE In addition to the basic pay and any longevity pay, . all sworn police personnel shall receive a 5% educational incentive salary step increase for attainment of a P.O.S.T. Intermediate Certificate, or an A. A. degree from an accredited college; whichever comes first. Also, all sworn police personnel below the rank of Lieutenant who have received a P. O. S. T. Advanced Certificate or an A. B. degree from an accredited college shall receive an additional 5% educational incentive salary step increase. However, to remain eligible for either incentive pay, an employee must maintain a minimum of 100 hours per year of education or training, 50 hours of which must be academic course work. This educational incentive section shall be administered by appropriate detailed rules and procedures established by the City Manager. SECTION 10. Anniversary Dates (a) Employees shall have as employment if employed on the fir their anniversary date the actual date of their t day of a calendar month; otherwise, the anniversary date for purposes of the compensation plan shall be the first day of the next succeeding month, provided, however, if the date of emp1_oymaz t is the first working day of the month, anniversary date shall be the first date of the calendar month of employment. SECTION Il. Qualifications of Employees (a) No person shall hereafter be employed or appointed to any position requiring full-time or part -•time service and which position is included in the classification plan and for which a class specification exists establishing desirable qualifications unless said person possesses substantially the desir- able qualifications of education and experience prescribed for that class. SECTION 12. Employment and Hiring (a) Selection of new employees to fill vacancies within the City Service shall be on the basis of merit qualifications appraisal process as stipulated in Section 11, or a more formal examination process may be utilized in the selection of new employees. (b) The City shall have the right to require all employees to complete and submit any applications, agreements, or statements pertinent to their _employ- ment as stipulated by decision of the City Manager. (c) The City shall have the right to require a medical and physical examination of any applicant for employment or new employee and, in addition, shall have the right to require periodic medical and physical examinations. of all City employees. SECTION 13. Promotion, Demotion, Transfer and Assignment, and Applicable Pay Pates (a) Promotion of employees to a higher class or demotion to a lower-class within the City shall be made by the City Manager. (b) A promotion to a higher class shall be on the basis of assignment of substantially more responsible duties commensurate with those set forth in the class specification. (c) A demotion to a lower class shall be on the basis of assignment of substantially less responsible duties commensurate with those set forth in the class position. (d) In the case of the promotion of any employee in the City service to a position in a class with a higher pay range, such employee shall be entitled to receive the rate of compensation in the entrance step of the class to which he has been promoted. In cases where the pay range overlaps, promotion shall be effected at the step in the range of the new class which is next higher than the employee's current salary. A new anniversary date shall be established for purposes of eligibility for future step increases in the same manner as set forth in Section 10(a). (e) In the case of demotion of any employee in the City service to a class with a lower pay range, such employee's salary shall be reduced to a pay step in the lower range corresponding to not less than one step in dollar amount below that which he held in the higher class before such demotions in such cases, the employee shall retain his original anniversary date. (f) In the case of the transfer of any employee from one position to another in the same class, or to another class to which the same pay range is applicable, the employee shall remain at the same pay step and shall retain his original anniversary date. SECTION 14. Cumulation of Service in One Class of Position Whenever an employee accepts work under a different class of position in the City service, the character and nature of which work is similar and the responsibilities are equal or superior to the work such employee has been performing, and later returns to his former position, his term of employment under such different class of position shall apply on and be added to his term of service in the former class upon his return to same, provided his employment accepts work in such different class. •-9_ ;r. SECTION 15. Hours of Work (a) All City employment excepting Fire Department shift personnel (67.2 hour week) is based on a 40 hour week. (b) Daily hours of work (or shifts) for employees within departments shall be assigned by department supervisors as required to meet the operational requirements of said departments. (c) Monthly compensation shall be based on a 40 hour work week and no authorization may be made for an employee to work less than said 40 hours without directly proportionate .decrease in compensation. (d) Any forseeable absence or other deviation from regular working hours desired by an employee shall, in advance, be cleared through the City Manager, and such absences shall be noted on the employee's time sheet. (e) Call-in Time - Regular Fire Personnel: Call-in time in response to a fire for off-duty, full-time fire department personnel shall be considered reimbursable overtime and shall be permitted only at a straight time, 40 hour per week, hourly equivalent of the monthly salary, based on the step and range applicable to each individual fireman. When persons above the fireman classification are on emer- gency call-in, they shall also be thus compensated in their appropriate step of the salary range applicable to their classification. Payment of call-in overtime shall be subject to the limitations of budget appropriations available for such expenditure and, in the discretion of the department head, compensating time off may be substituted for overtime pay. A minimum of two hours shall be credited for each,^ emergency call-in and, in computing actual hours worked over the minimum, it shall be based on the nearest one-half hour of time. Any call-in which results in continuous duty exceeding 12 hours shall be considered as being called in for an additional who) • shift, and the employee shall remain on duty for the balance of the shift and be compensated at the shift rate for his call-in time. SECTION 16. Part -Time Employment Except as otherwise provided herein, a daily work schedule of less than the umhr?r rr;: of hot, c: of full-time employment shall be considered part-time service, and the actual compensation therefor shall be determined by the relation that the actual number of hours of service bears to the number of hours required in full-time employment in each class of position. The hourly rates prescribed for part-time employees are considered full compensation to include the vacation, sick leave and holidays. SECTION 17. Overtime (a) It is the policy of the City of Hermosa Peach to avoid the necessity for overtime work whenever possible. (b) If, in the judgment of the department head, work beyond the established work week is required, such work, except in the case of immediate emergency, shall be performed only with the prior authorization of the City Manager. (c) In emergencies, where prior authorization cannot be issued, the depart- ment head shall obtain approval for the overtime worked by an employee at the earliest opportunity thereafter, in no case to exceed ten (10) days after the date worked. (d) Overtime work shall be compensated on the basis of equivalent time off, or by paid compensation at the straight time hourly rate equivalent to the monthly salary, at the discretion of the City Manager, except sworn police personnel required to work extra shifts or portions of shifts shall be paid at time and one-half. Training sessions and carry-over due to assignment completion shall not qualify for time and one-half. (e) Incidental overtime is not compensable and may not be credited as overtime. (f) The time when compensating time off may be taken shall be at the discre- tion of the appointing power. If the employee fails to take his compensating time off at the time designated by the appointing power, he shall have waived his right to com- pensation for such overtime. (g) In those departments in which regular shift assignments require an employee to work on an observed holiday during which other City employees are not required to work, such employee shall have credited as overtime the hours equivalent to those which he worked on the holiday. ''ii. SECTION 19. Holidays (a) Regular Employees (1) With the exceptions hereinafter stated, holidays for all officers and employees of the public offices of the City of Hermosa Beach shall be January 1, February 12, February 22, May •30., July 4, September 9, and the first Monday in September (Labor Day), November 11 (Veterans' Day), Thanksgiving Day, the Friday following Thanksgiving Day, December 25, and every day appointed by the President of the United States or by the Governor of this State of public fast, thanksgiving or holiday; provided that on any day appointed by the President or the Governor as a special or limited holiday, City offices shall function in their normal and usual manner and all other public functions shall be performed as on days which are not holidays. (2) A special or limited holiday is hereby defined as a holiday applying only to a special class or classes of business, or a special class or classes of persons, and not appointed to be generally observed throughout the State by all classes of business and allclasses of persons. (3), If any of the foregoing holidays fall upon a Sunday, the Monday fol- lowing shall be observed as a holiday. If any of the foregoing holidays fall upon a Saturday, the Friday preceding shall be observed as a holiday. -12- (b) Police Department Personnel (1) Shift personnel in the Police Department, due to seven day per week working requirements and in order to provide equity with holidays authorized other City employees, are entitled to the equivalent of eleven (11) working days credit per year in lieu of holidays. Such credit maybe taken as compensating time off at times approved by the department head. (c) Fire Department Personnel. (1), Shift personnel in the Fire Department are entitled to the equivalent of five (5) shifts credit per year in lieu of holidays. Such credit may be taken as compensating time off at times approved by the department head. SECTION 10. Sick Leave with Pay. (a) Each full time, regular City employee may be granted one working day of sick leave with pay for each calendar month of service on the submission of satisfactory proof of the necessity for sick leave. Fire Department shift personnel. shall receive one (1) shift per calendar month sick leave credit. Police Department shift personnel shall receive the same credit as regular employees. (b) Sick leave shall not be considered as a right or privilege which the employee may use at his discretion,, but shall be granted only in case of a bonafide illness of an employee or in case of the death of a member of. an employee's immediate family. In the latter case, allowable sick leave shall not exceed five (5) days. (c) Sick leave may be accumulated without limitation as to maximum. (d) A city employee who is entitled to temporary disability indemnity under the Labor Code may elect to take as much of his accumulated sick leave or his accumulated vacation in addition to his disability indemnity as will result in a payment to him of his full salary or wage. (e) H' lidays occurring during sick leave shall not be counted as a day of sick leave, except for police and fire shift personnel in which case holidays and sick leave shall be unrelated and will be handled separately. -13- (h) The monthly salary shall be considered full compensation for all hours. workeu, and no overtime shall be considered accruable, for the following employees; 1. Park, Supervisor 9. Planning Officer 10. Police lieutenant (overtime paid for extra shifts or assigned special hours, but not for extra hoursconnected with regular assigned shifts) SECTION 18. Vacation Leave with Pay (a) Except for the fire shift personnel, every employee shall be allowed vaca- tion leave with pay at the rate of twelve (12) working days for each year of: service; provided that no vacation shall be granted during the first six months of employment; but on successful completion thereof, vacation time shall be allowed for time of service accrued. Everyemployee completing ten (10) years of service shall be granted an additional five (5) working days of vacation leave with pay. Upon completion of twenty (20) years of service, an additional three (3) working days of vacation leave shall be granted. (b) Fire shift personnel shall be granted eighteen (18) calendar days of vaca- tion. Upon completion of ten (10). years service, an additional six. (6) calendar days shall be granted. Upon completion of twenty (20) years of service, an additional six calendar days shall be granted. (c) Vacation credit shall accrue to the employee monthly. (d) Vacations shall be scheduled by the Department Heads sous not. to inter- fere seriously with or impair the efficiency of the various departments, and if deter- mined to be in the best interests of the City. Vacation leave may be accumulated to a maximum of twenty (20) days, with approval of the City Manager. (e) An employee about to resign, about to retire, or who is to be laid off, and who has earned vacation time to his credit, shall be paid for such full days of vacation remaining due the effective date of such resignation, retirement or lay-off. (f) Holidays occurring during a vacation shall not be counted as a day of vacation, exce t Fire shift personnel in which case holidays and vacations shall be unrelated and handled separately. -14- (f) Paid sick leave shall not be granted for illness due to pregnancy. (g) Evidence, in the form of a physician's certificate or otherwise, may be required in determining the adequacy of reasons for any employee's absence during a time for which sick leave is requested and for all sick leave requests in excess of five days (three /3/ shifts for fire shift personnel) , except as otherwise determinFd by the City Manager. (h) No payment shall be made for accumulated sick leave at the time of termination or retirement from employment. SECTION 21. Incompatible Activities No full-time employee of the City shall engage in any occupation or outside activity which is incompatible with his employment by the City. Any officer or employee engaging in an occupation or outside activity for compensation shal inform the City Manager of the time required and the nature of such activity, and the City Manager shall determine whether or not such activity is incompatible with City employment. SECTION 22. Personnel Records The City Manager shall maintain such employee records as are necessary to the accomplichment of the various provisions of this resolution. These records shall include the record of employment of each employee in the classified service, including dates of service, positions held, salaries or wages receiv'.'., vacation, sick leave earned and taken, and other such information as may be deemed appropriate. SECTION 23. Military Leave Military leave with pay shall be granted in accordance with Section 395 of the Military and Veteran's code. SECTION 24 Definition of Terms The words and terms defined in this section shall have the following mean - lags in this resolution and in any other resolution classifying and fixing the salaries and compensation or authorizing the employment of personnel in any department or office of the City. (a) "Class" or "Class of position" means a definitely recognized kind of employment in the City Service designed to embrace all positions having dnfi',c -15- r : ' ,•; , Ind responsibilities sufficiently similar so that the same title may be used; the same requirements as to education, experience, knowledge and abiltiy may be demanded of incumbents, and the same schedule of compensation may be demanded of incumbents, and the same schedule of compensation may be made to apply with equity. (b) "Title," "Class Title," or "Title of Class" means the designation given or the name applied to a class or to each position allocated to the class. Its meaning is set forth in the corresponding class specification. (c) "Position" means a group of current duties and responsibilities assigned or delegated by competent authority, requiring the full or peat time services of one person. (d) "Employee" means a person legally occupying a position in the City Service. (1) "Regular employee" shall mean all employees in the classified service of the City of Hermosa Beach, excluding uniformed police and fire personnel regularly assigned to shifts. (2) "Police Department personnel" shall mean the head of the depart- ment, all uniformed police personnel and the other employees who work shifts involving Saturdays, Sundays, holidays and unusual hours of the day. "Fire Department personnel" shall mean the head of the depart- ment and all uniformed Fire Personnel. (e) "Limited Service" or "Casual Service" is defined as employment on a part time or seasonal basis of a nature which is not equivalent to any position in any class included in the classification plan. (3) (f) "Allocation' means the official determination of the class in which a position shall be deemed to exist and the assignment of an individual position to an appropriate class. (g) "Reallocation" means a reassignment or change in allocation of an individual position by raising it to a higher class, reducing it to a lower class or moving it to another class at the same level on the basis of substantial changes in the kind, difficulty or responsibility of duties perfor med in such position. -16- .t ; (h) "Probationary Period" means a working test period during which an employee is required to demonstrate his fitness for the duties to which he is appointed by actual performance of the duties of his position. "Auxiliary Firemen means any employee who, by assignment by his department head and acceptance by the Fire Chief, shall participate in training, drill, or fire fighting services during normal employment hours or otherwise in addition to his regular position, and he may be compensated therefore as an Auxiliary Fireman as set forth in the salary resolution. 0) "VolUnteer Fireman" shall mean any person not otherwise employed by the City of Hermosa Beach who offers his services for training, drill and fire fighting services and is accepted by the Fire Chief, and he may be compensated as a Volunteer Fireman in accordance with the provisions set forth in the salary resolution. SECTION 25. Resolution No, N.S. 2757, as amended, is hereby rescinded' as of July 1,1.970, and this Resolution shall take effect as of the first day of July, 1970, and the City Clerk shall certify to the passeee and adoption of this Resolution; shall make a minute entry of the passage and adoption thereof in the records of the procndings of the City Council of said City in the minutes of the. meeting at which the same is passed and adopted. SECTION 26. The provisions of this Resolution shall be liberally construed and, interpreted to giv- effect to this policy of equal treatment and regard of all municipal employees of the City of Hermosa Beach. FOURTH: To furnish the necessary material and labor, to furnish and to replace lamps as same become broken or burned out, and to replace such lamps, lighting units, glassware, or any other portions of the lighting system which may become broken or damaged or unfit for use except those lights whichare scheduled as "City Owned, City Maintained", all for a period of five (5) years commencing July 1, 1970, said replacements to be made of a like material equal or better in every respect to the material which is being replaced; and to furnish necessary labor to keep the glassware,located at the top of the lighting standards, in a good, clean and presentable condition, except those lights scheduled as "City Owned, City Maintained". The City Engineer shall determine what additional services are to be required by the contractor, and upon re- quest, the contractor shall furnish said services as specified by the City Engineer. SPECIAL PROVISIONS In lieu of advertising for bids for the services above referred to, the City Council may proceed under Sections 18171 and 18171.1, Division 14, Part 1, Chapter 3, Streets and Highways Code of the State of California, by the adoption of the appropriate resolution. All work shall be subject to inspection and approval of the City Street Superintendent of said City of Hermosa Beach, California, and no work shall be paid for until same has been approved. Said Street Superintendent shall be notified of any proposed new street lighting installations at least forty- eight (48) hours in advance of such installation. On May 19. 1970, the City Council referred back to the Planning Commission the appeal of James Fucile from the denial by the Planning Commission of the above request. In referring the matter back, the City Council specifically stated that it wished to express no comment regarding the merits of the case nor to offer the Planning Commission any suggestions except that the Commission should study a broader area and report back in 90 days. In considering this Council request, the Commission noted that: 1 The zoning of adjacent property is C-1 rather than C-3. The Commission felt that this would not alter their past reasoning. 2 The City Council is required by ordinance to make a decision on appeals within 40 days of closing of the public hear- ing (or by July 9, 1970). 3. The Planning Commission had previously indicated that it did intend to study the zoning and future land use of this area and would initiate rezonings when the problem was resolved- with the help of the property owners in the area. The Commission recommended, Comm. Mulfinger opposed, that the City Council sustain the action of the Planning Commission and that the Planning Commission will form a study committee to consider traffic flow and police problems in the area, utilize the 1970 census and the planned development district. and initiate any zone change that proves to be wise. In a sub4equent interview with Mr. Yorg. the Commission agreed to re -review the matter in order to eliminate any possible claim of biased or incomplete consideration if such action were legally permissable. McDaniel, City Manager SUBJECT: Shakespeare Lane Situation Gentlemen: The letter from these residents is not a new expression of interest to the City Staff; this situation has been discussed many times, and the issue has been raised more than once by Warren Miller in particular. In response to it, we have spent a great deal of time attempting to devise a reasonable solution to the problem which they describe. The difficuZty with placing a barrier acs the aney at some point is primarily two -fold; Utilitsy vehicles such as trash trucks and the street sweeper would be unable to perform properly. (b) More critically, ail transient automobiles who turn into the alley by mistake would proceed to the barrier, and then have to find some way to turn around in order to go back. In this narrow alley, there Ls no way to do this other than by danger- ous backing and then tre5passing on to private driveways and parking pads in order to execute the turn. A possible solution at the walkway points to the Strand to protect bicycle traffic exiting from them would be to provide some additional protective barrier for a few feet into the alley, and we have taken a preliminary look at this. Otherwise, the best solution appears to be additional traffic speed enforcement, and perhaps the second motor officer can show some activity in this regard. RespeCtfully submitted, WESLEY C. This legislation, being supported by the League of California Cities, would provide for the termination of unproductive oil leases which encumber the surface rights of land and prevent development, although not producing oil in sufficient quantities to justify continuation of the encumbrances. SB 967 defines in the absence of other specific defini- tions or proof to the contrary, that production which is sufficient to yield a reasonable rate of return to lessor and lessee, and provides that in the absence of such production, the lease shall be deemed to have terminated by its own provisions. SB 966 establishes a proced- ure for either the lessor or lessee to bring an action to partition the rights and interests of the lessor from those of the lessee. Preliminary drafts of this legislation, prepared by the Ad Hoc Committee for the Termination of Unproductive Oil Leases, are attached for your consideration. DISCUSSION - City Manager McDaniel informed the Council that the report received from Chief of Police William H. Berlin, Jr. stated that there appeared to be inadequate facilities for the preparation and storage of food, with cooking facilities limited to a sandwich heating machine for on - premises food preparation, and it was therefore the recommendation of the Police Department that a protest be filed with the Department of Alcholic Beverage Control relative to the "Eating Place" portion of the license, with a recommendation that only the On Sale Beer License transfer be granted. Mr. Daniel L. Held was present and in reply to a question from Councilman Wise stated that he had discussed this matter with•Officer Moore and that it was his intention to serve only sandwiches and beer -and that he was. aware that an eating place could not bar minors but that this was not the clientele he planned to serve. Mayor. Pro Tem Valentine felt that the City should seek a.. clarification of the eating place status from the Board of Alcoholic Beverage Control and for that reason should file a technical protest on this point. However, during a review of the premises prompted by the application for transfer, our detectives found what appears to be inadequate facilities for the preparation and storage of food. The premises is licensed as "On Sale Beer - Eating Place", and the transfer requested, if granted, would include the passing of the "Bona Fide Restaurant" portion of the license. Cooking facili- ties are limited to a sandwich heating machine for on -premises food preparation. It is our opinion these 'facilities are inadequate to qualify the business for the title "Eating Place".
