AWOURNMENT August 4, 1970 TO: Honorable Mayor and City Council FROM: Planning Commission SUBJECT: Appeal of Board of Zoning Adjustment's Approval of a Request -for Variances on Lots Located at 144-148 Lyndon Street, Gentlemen: The City Planning Commission has initiated a study of the subject area rela- tive to implementing the General Plan. In this respect: 1, The Land Development Sub -committee is inviting all property owners to a meeting August 110 1970 in the Council Chambers., 2 The General Plan shows high rise motel -tourist comm. ercia/ uses. 3. The R -P zone deliberately does not allow apartment development of small lots. 4, The Commission is considering requesting a moratorium on new residential development in this specific area pending resolution of the precise plan. 5. The proposed continuous curb cut on Herondo (aided by a previous variance granted to these same parcels) could be highly detrimental to Herondo traffic., We respectfully suggest that the Board of Zoning Adjustment did' not have benefit of complete knowledge of the above when it considered this request. We request that this item be returned to the Board of Zoning Adjustment, and if same is done, we, the Planning Commission are ready to meet with the Board of Zoning Adjustment, the property owners„ and ail interested citizens to explain in depth the planning program for this area. McDaniel, City Manager SUBJECT: Ardmore Avenue Parking Study Gentlemen: A new development has recently come forth which will have a significant impact upon the question of proper parking and speed regulations on Ardmore Avenue. This is the request by the County Flood Control District to close Valley Drive south of Second Street on approximately August 15 for a four- week period in order to construct a major underground structure in conjunction with a tunnel which they are commencing running easterly under the hill at the eastern edge of our city. This tunnel is the key element inu a major contract under the last flood control bond issue, and fill from the portal opened next to Ardmore will probably be used for the Herondo project. The plan is to cross Valley Drive in order to construct the sub -surface facility, routing all traffic two ways on Ardmore. Upon completion of the Valley Drive portion, it will be placed on two-way traffic and Ardmore will be closed in order to complete the same construction across that street. We feel that these two temporary closures give us an ideal opportunity to study and experiment with the resulting traffic flow on both Valley and Ardmore, and will give us much better information upon which to base future decisions involving the widening or other improvement considerations of either of these streets throughout the length of the city., 1,A e are looking forward to these two closures in order to observe the traffic behavior and its effects, and are mak- ing provisions for special traffic counts and radar speed checks. It is our recommendation that approval be given to temporarily posting all of Ardmore Avenue south of Pier to the city limits for "No Parking" at any time, in order to facilitate this increased traffic flow. During this period, we will also be able to view the effects, at the conclusion of the period, when traffic is returned to Valley Drive, we will be in a position to make a permanent report and recommendation to the City Council on both parking and speed control. GatTlin trioia PUBLIC HEARING - PROTEST AND APPEAL VARIANCE GRANTED BY BOARD OF ZONING ADJUSTMENT - Property located at 144-148 Lyndon Street - B.Z.A. 154-20, adopted June 8, 1970 - Continued from July 7, 1970. DISCUSSION - The public hearing was reopened by Mayor Thelen, and in reply to a question from Mr. Roy Lyon, 160 - 1st Street, Councilman Wise stated that this variance would affect only two pieces of property in this. tract. Mr. Kenneth Komick, 107 Pacific Avenue, Manhattan Beach, tentative purchaser of the subject property then informed the Council that he had studied the revised parking facility recommended by Councilman Wise and Councilman Valdes following their meeting with owners of adjacent properties, and that although he found merit in the concept it would require additional investment and it would not be possible for him to acquire an increased building loan due to the risk factors involved. Fie added that he bad been unable to find any alternative to his original parking facility plan that was economically feasible. As no one else wished to speak, the public hearing was then closed.. Preceding discussion by the Council, Councilman Wise wished to go on record with the fact that the City Attorney had advised him to abstain from voting on this matter. PROPOSED ACTION - to uphold the decision of the Board of Zoning Adjustment granting a zone variance to permit the construction of two four -unit apartment houses, one on each lot at 144-148 Lyndon Street, in lieu of maximum allowable of two units per 1-ct. Motion by Councilman Valentine - Second by Mayor Thelen. FURTHER DISCUSSION - Councilman Bigo expressed the opinion that because Councilman Valdes had been involved in the meeting with neighboring property owners, his vote was needed in determining this matter, and after discussion with the City Attorney regarding the votes needed to uphold or override the decision of the Bo rd of Zoning Adjustment, Mayor Thelen withdrew his motion with consent of ih,., second. Mr. James Huntsman, 201 North Sepulveda Boulevard, Manhattan Beach, representing Mr. Harold Hargrave, present owner of the subject property, stated that he did not believe the presence of the full. Denison, 234 First Court. D!SCUSSIoN -- The public hearing was opened by mayor Thelon, and eui1ding Director Bud M. Trott outlined for the Council the public hearing held by the Board of Zoning Adjustment and their decision to approve and grant a variance to permit the rection of two four -unit apartment houses, one on each lot, in lieu of the maximum allowable of two units per lot. Mr. Kenneth Komick, 1007 Pacific Av ague, 1anhattan Beach, contractor for Mr. Hargrave, was present to peak on :.ehalf of the property ewer and replied to questions from the Council regarding the set -back and curb cuts that would result from the construction as planned. Councilmen Valdes and Wise suited that they had attended a meeting held by residents and property owners in this area in order to becombatter• acqus inted with their Objections to the granting of this variance, and it was their opinion that no one in the neighborhood objected to the construction of an apartment complex, but th=:t they felt that parking problem would result from the intended garage facilities. Councilman Wise then brought forth parking plan which he felt would olve the prdblem of curb cuts by providing inside parking and ingr se and egre .a on one driveway, and Mr. Komick expressed interest in studying this revised plan. It was suggested by Councilman Valdes that this hearing be continued to the next regular meeting of the Council so that Mr. Dick could study the proposed revision and perhaps reach a decision regarding its feasibility, and he and the other members of the Council, would also have an opportunity to examine it before attempting to come to a deci ° ion. ter. Komick pointed out that he had had the subject property tied up in escrow for some time, and that further delay might cause problems, but that he felt th.;:t' this new suggestion might be worth considering. Mt. James Huntsman, 201 North Sepulveda Boulevard, Manhattan Beach, real estate broker for Mr. Margrave, stated that this property had been in escrow originally set to close on May 26th, and that Mr. M. rgrave was understandably anxious to avoid having to wait much long and had hoped that 'this matter would be re= olved this eek. The attached agenda was discussed, The City's projected Revenue - corrected by Mr. Philips of Edison Co. to be "money set aside by Edison for undergrounding Edison facilities Within the corporate limits of Hermosa Beach" -- was shown to be $93,000 at the start of calendar year 1971. Edison and General Telephone representatives indicated emphatically that their corporations were opposed to using any of the "8209" funds for participation in assessment districts, or "seed money" for larger projects which would include assessments and bonds. They wished it made clear that there was no intention to give money to the City, or to allow the City to contract for work with these funds. The money is Edison, the job will be Edison engineered and contracted. 'Edison will accept cash only for work outside or in addition to the "8209" money. A discussion was held regarding present difficulties .in neighboring cities with assessment districts for underground wiring. It was decided that where a street improvement project was in process it would be possible to save money in undergrounding_utilities. Three tentative projects were outlined: Pacific Coast Highway from south Boundary to Pier Avenue; Pier Avenue from Pacific Coast Highway to Manhattan Avenue; and south Hermosa Avenue, Maps are to be prepared by the City showing the outlines of these three projects, The affected Utility Compan!es will estimate the cost of undergrounding in each of the projects. The Committee will meet again August 11, 1970 2:00.p.m, to consider these costs • and recommend a first project to the City Council. • TRASH AND LITTER TESTING PROGRAM - FINAL RE,PORT INTRODUCTION During mid -summer 1969 the Impl:'oVement Commission began looking for solutions to the many trash. and Iitter problems in the city. For ease of dealing with the n iftitcl problem, three sepaTate and distinct categmles were created, each. dealing with a portion of the oveT-a.il pob18170. The first and most broad based of these categories is the residential portion. .After a good deal of study, research, and analysis, it was determined that th.e problems were, a combination of inadequate, deteriorated and lidless containeFs along with.noisy collection and lack of proper storage space. After extensive product review the Refuse Committee, consisting of Betty Ryan and various staff me,m.bers, proposed the use of a one-way collection system. Consequently, a multifa,::eted test, examining all the characteristics of the new system, was initiated. The test was divided, into three components; ie Environmental/Comparison test, Efficiency test, and Public Acceptance test., A numb of one-way containers are on the market, each with advantages and disadvantages - in order to ds-',-,SrMine the best one suited to our needs we in- cluded one block sectiOns„ eac;n, using different p'oducts in theover-an test. Un- fortunately, our supplier will not continue this arrangement. If we are to con- tinue bag sales - we must make an initia purchase and then resell to the public. This could be done on a reimbursable basis but would require a one time outlay of $1,550 for 1,000 rolls. It is the Litter Committee's recommendation to engage in such a program° Combined with the bag sale program, an effort to advertise and publicize the advantages must be undertaken. The new refuse contracter, ARCO has in- dicated they will be doing just that an.yway. Out part could involve "pep -talk" messages on the refuse bin, notices in the, Newsletter, etc. The aim would be to ix/crease the voluntary use of the bags. The second major portion of the over-all test is the, commercial litter experiment. The Litter Committee believed th.ese litter probles•,ss are a 0. r.r.xs.sfa:sztasilor physical problems: the commercial areas are not conducive to cleanlineSs. The intent was to replace the 50 gallon (.3ums with attractive eye -appealing containers. Initially, 0111-5' thought was to use fiber glass containers, however, at Mayor Thelenus suggestion we tested the material for flamibEity and found the containers actually supported flame. Consequently, the containers did not fulfill our needs. Further :product gesearch was conducted and seven concrete containers were purchased at $70.000 each. Initially, they were placed along lower Pier Avenue between Hermosa Avenue and Beach Drive after the sidewalks had been steam -cleaned. The reaction from the merchants „ patrons,, and visitors seemed (mite favorabie. The con- tainers did infaqts: beautify the aroa, both in terms of litter control and asethetic considerations „ Eight weeks Rater, the containeys v,Tere transfered to thn 2nd Street and Hezmosa AVertUk3 area. Once these are completed further analysis and review can be made. • -4- lu The third portion of the overall test was the Beach/Pier/ Strand area, The problem here was overflowing barrels and private use of public containers. Our strategy was to replace the large drums with small pole mounted con- tainer; thus forcing residents to use their containers and allow Beach and Strand users the availibility of the new containers.: The results of the ex- periment were mixed Initially° two containers were stolen, either by frustrated Strand residents or professional vandals, At the remaining locations, inventive residents thwarted our approach by purchasing our plastic bags at the Fire Department and placing their personnel trash in a filled sack adjacent to the pole mounted containers', Both these practices ceased to be a problem after the first few weeks. The containers presented a problem for collection 'also, mainly because we under -assessed the volume of refuse from the actual beach users. Now that the residents seem to accept these new containers, we plan to continue the experiment except to increase the number of large barrels on the beach itself in order to draw off the litter generated by the beach users. A report on these results will follow. COMPENDIUM All in all, the litter testing program was a success. It did not (by a long shot) solve our litter problenisl, however °.t did reveal Important insight into the nature of the problems. Gen- erally the activity will mirror last year's event. Serious South Bay artists will be invited by the Commission to provide enter- tainment for Hermosa Beach citizens as well as providing themselves with an opportunity to display and sell their works. Again it is hoped the city will provide central cashiering and the use of the city's resale license. Proceeds from the sales will go to the artists whild normal sales taxes will be sub - vented to the city. If approved, the Commission would further request a waiver of license fees for all participating artists and craftsman. The Commission believes the event will not only provide "a good time for all" but also promote the enhanced image of our community. Fowler On July 17th this department received a complaint from Mrs. Mount - 217 -29th St. 372-0103 regarding beer cans on bushes and strung on neighbors fence. Mrs. Mount indicated the neighbors were ready to sign a petition regarding this situation and regarding the ge- neral disruption of the neighborhood with regard to the constant partying that takes place at the above address. Mrs. Mount WAS informed by this department that. our authority . in this situation was in a gray area, however, we would investi- gate and do whatever we could. Frank Holland was assigned to handle and he requested guidance concerning our exact position in the matter.' I suggested he talk to them and try to have them remove the cans on their am, however, if that didn't work or if they questioned his authority, cite them section 14-20 of the Municipal Code. /mit Following Frank's investigation, he informed me he had them section 14-20 and they agreed to remove the cans by August lsst. Connection Fees (Continued) Councilman Wise added that at the request of the City Council this City's Board of Appeals had appointed a committee of its members to consider this problem, and that after careful study of fees charged : by neighboring cities for connections to the city sewer system this committee had recommended that this City establish a charge to be collected for all additional connections to the sewer system in order to provide a fund. to be used only for the replacement of the existing sewer system or the construction of new suers where necessary -fix the public health and safety. In reply to questions from the Council, Building Director Bud Mb Trott stated that the method and rates of collection were based upon the Uniform Plumbing Code, 1967 Edition, and that it was consistent with fees charg-:ci by other cities. At the request of Councilman Valentine, Ma:. Trott stated that the Board of Appeals members who had served on the committee studying this matter were Mr. John B.
