C„ 154-783 - A RESOLUTION OF THE CITY PLANNING COMMISSION OF HERMOSA BEA:DH DEWING A RE:QUEST FOR A CONDITIONAL USE PERMIT TO PROVIDE ENTERTAINMENT AND DANCING AT 2626 HERMOSA AVENUE. - WHERL'A! S, the City Planning Commission of Hermosa Beach, at a public hearing held August 31, 1970, considered the request of Melvin Hochman ab a Bounty for a conditional use permit to provide entertainment and dancing on lots 4 and 5, block 109, 1st Addition to Hermosa Beach Tract, known as 2626 Herraosa Avenue; and WHEREAS, at said hearing the following matters were considered: L Distance from residential and non-commercial uses - Residences immediately adjacent to rear. Commercial businesses adjacent and across Greenwich Village. 2. Amount o off-stres-it parking - Ten spaces available on leased let adjoining to north. 3. Location of and distance. to churches, schools „ public playgrounds - Nearest school 560 feet from premises,. Public heath 200 feet from premiscis,.. 4 Hours of operation,: - 900 p. to 100 a. 5 3ornbination of uses - Serving of meals, alcoholic bever- ages, live entertainment and dancing. 6. Precautions taken by owner to asur 8 compatibility of the use with surmunding areas - None beyond existing conditions. 7. Relation of business to traffic 'volume and size a streets. Routes of ingress and egress and effectaan street and pedes- - trier?. traffic - busin,ess- is located at intersection of Green- wich Village (street) and Hermosa A.venue, both heavily traveled streets. Parking lot is located o Hermosa Avenue, n,o apparent taorMict with street traffic. Park:tag lot adjacent to residences. 8. Proposedexteriors'. signs card decor; advertising - No changes indicated in present decor. 9. Number of similar establishments in close proximity - None • -2- l(4. Other consideratiOns — a. Establishment -is a non-conforraing use„ the sale of liquor not being allowed in the C- zone. b. The premises has changed operators at a rate well above average (3 changes in 3 years) indicating the business may be marginal in this location. c.. The provision of live entertainment and dancing would likely change character of business from restaurant more toward night club. d. Night clubs are not permitted in the Cl zone. Existing entertainment establishments in downtown Hermosa have problems with crowds, noise and parking;, and V HEREAS , at said hearing, a petition of protest was submitted bearing signa- tures representing fifty-eight properties; and WHEREAS, at said hearing it was indicated that present operation. is exces- sively noisy; and VHEREAS, after due consideration it is the opinion of the Plannird.g Commission that: l There exists insufficient off-street parking to support this type of use. 2. The proposal would create an imposition to other residents in the area because of noise and amplified instruments; 3„ Current establishment is a non -conforming use and the granting of this permit would further increase the non-conformance; 4 Music and dancing would tend to create a "night club" of the restaurant, which is not permitted in a C -I zone; $ Based upon experience with similar establishments in the city, there would be large crowds and noise. 6 The Commission has received strong opposition from residents complaining about noise. • 7 The proposed use is incompatible with the potential- use in the area, NOW THEREFORE BE IT RESOLVED that the City Planning Commission of Hermosa Beach hereby denies the request as submitted. On uguSt 25 .1970, this office .interviewed a Mr. Ron Cross, of 1825 Leola, L;)mita, telephone 325-8571, who is the proposed operator of the new premises known as Pioneer Chicken, to be located 1201 Hermosa Avenue, Hermosa Be. as well as a Mr. Roger Schwirnmer. a member of the Pioneer Chicken Corporation Real Estate Division, tele, 626-6511. We were provided with the following information: • The proposed .prernises is to be conducted in such a manner that the front of the building will actually face on Hermosa Avenue, with an entrance on Pier Avenue, and an entrance on the parking lot side of the building, which will be located -on the north portion of the lot. That there will be no takeout windows on any portion of the building, and that persons who desire to take out products will be required, to actually enter the premises, place their order andothen depart from the prern.isea through either of the exits. Therefore, we ,:an bee no problems -caused by loitering or cost, - ()viers waiting on either Hermosa Avenue, the parking lot or Pier Avenue. The addresseb of three llocabtions 'Which have exact or similar operations to that proposed at 1201 Hermosa Avenue, were sub- mitted by the subjects being interviewed. Those locations are as follows: Washington and Lincoln Blvde. The first two locatoons were examined by this office, and the following conclusions were dr wn: Both premises were neat and clean in appearance, well landscaped and appeared to have sufficient entrances as well as exit lighting. Further, both of the premises were of 31111&lier types than is proposed here, sincethey provided sitting for ap- proximately 20 people and waiting area =for *pproldiaaately 6 people. The adjacent grounds next to the premises were neat and clean and there was no evidence of litter within a one block area of the premises that could have ?asibly been cased by takeout food frc.irn the Pioneer Chicken Restaurant. Based on our observation of the to premises examined and the general plot plan of the proposed establishment, we concluded that this premises would not normally create a loitering or ad- jacent juvenile problem. We would, however. suggest that should the Planning Commission approve a conditional use permit, that adequatearrangements be made for v4Ilitcles parking on the park- ing lot area, be caused to enter the rking area from 13th Court. Further, that adequate signing be provided to insure that vehicles departing the parking area be informed they are required to turn left and proceed in a westerly direction on i 3th Court, in order to comply with our one-way street system at that location. Further, that sufficient lighting be installed and operating from sundown until such time as the prerni4es are closed, in ord that the parking area he well lighted so that the average person driving by on Hermosa Avenue and/or 13th Court, could detect the presence of any person in that parking area. This activity was instigated at the request of Mayor Thelon, with approval of the City Council. Following that preparation, the rendering was displayed at the Bank of America for review by interested persons, and Mayor Thelen undertook to secure expressions of interest, although not in the form of formal agreement, by affected property owners. This has proven to be a frus- trating task. However, the Mayor now feels that sufficient expressions of interest have been received that the Council may reasonably instruct the staff to proceed with the necessary preliminary engineering and architectural cost estimates leading to formal formation of a district by the Council -initiated (reVerse) method. His preliminary suggestion is that all sidewalk and beautification work be covered by the assessment, with the city contributing to the cost of nece;ssary street resurfacing. We will have the renderings and other material available Tuesday evening so that the Council may refresh its memory if you wish. The district is largely created for the purpose of reconstructing and widening the sidewalks, and in the process including as much beautification as possible. H.S. 389 recently adopted and which provides for a sewer connection charge for all new construction, it has bean broueht to the attention of the writer that Section 28e70 subsection (C) which states the following, "Fees shall be collected prior to the issuance of any building, plumbing, electrical, or applicable permits", is going to create an undue hardship o the Builder or Developer of the large complex. As an example, we presently have a proposed 168 unit apartment in plan check. The sewer connection fee would ameunt to $14,400.00. Normally, the Builder or Developer is short of funds at the beginning stages of a development due to the fact that he must expend funds for land, building plans, plan check and building permit fees and many other incidentals. He is unable to draw on funds from the kmn agency unti1 he has completed a portion of the development. it would be my recommendation that Section 28-7® subsection (C) of Ordinance H.S. 389 be amended to add thereto subsection (C) "Exception: For new buildings or structures wherein there Is no permananet electrical service serving the premises, the sewer connection charge may be paid any time prior to final approval by the Building Department and before occupancy of said building, provided that if the fee is not paid within one year from the date of issuance of the building permit, there shall be an additional charge of .01% per month based on the required fee." For additions and remodels the fee would be paid as originally stated in the ordinance, since the fee would be minimal and would not create a hardship. Also, the Building Department would not be able to withold connection of the gas and electricai service on existing buildings which would already have such service in operation, and this could create a collection problem. Contact State Highway Department to see if signal phasing on Pacific Coast Highway can be improved to relieve rush hour congest on 2, Place -directional signs on Aviation and Pacific Coast Highway indicating location of Pier Avenue and Beach. 3, Partially barricade 10th Street (to cross/left turn traffic) -on a temporary basis, and determine resultant traffic flow change (a six week project, by staff estimate). 4. Restrict on -street parking on 10th Street during hours of 4:00 p.m. to 6:00 p.m. Place a speed limit sign. on 10th Street. 5. Do not close 10th Street unless all other avenues have been exhausted, and it is determined that a real hazard exists. Discussion: Traffic counts on 10th Street (attached) indicate that the primary traffic flow is during the "rush" hours. This further indicates that the 10th Street traffic is a spill-over of south bound traffic during the week. Visual analysis corroborates this finding, in that traffic is frequently b.p.014",ed u(p. frpka•i$th Strsett:MIOth,Enteet on Pec -Coasiliighway„ so;Ath- bound. 10th Street does provide a convenient escape route for Aviation traffic trying to move southward. Re -phasing of signals might solve this problem. During the weekends, traffic increases on 10th Street:, although the peak hours change to between 1:00 p.m. and 2:00 p.m. Residents indicated that some of this traffic is seeking, and failing to find, Pier Avenue. Directional signs, one on Aviation, another on Pacific Coast Highway would overcome this problem. A second right turn 1an0 , or permitting right turns from the middle south bound lane on Aviation., might also help alieviate the tendency to cross Pacific Coast Highway into 10th Street If the above actions fail to sufficiently reduce 10th Street traffic, 'the Commission feels that a partial barricade, permitting right turn entrance only from Pacific Coast Highway, should be attempted. The resultant traffic flow increases on 9th and lith Street should be measured. If, after a stabilizing period, no significant increase of traffic is recorded, it would then be reasonable to consider the creation of a permanent traffic island permitt ing right turn entrance and exit) on 10th Street. if it is demonstrated as unworkable to block the entrance to 10th Street, the City could consider restricting on -street parking during the peak traffic hours. It is the opinion of the Planning Commission that the total barricade Of 10th Street as requested would be not only a poor precedent for solving traffic problems, but would also create :police and fire problems. The Commission does not believe that the existing street pattern is the best possible for the City, 10th Street, however, is of more than. local importance. Fbwler On Friday, September 25e at 12x10 p.m. Chief Smith of Inglewood advised this department that a Civil Defense Yellow Alert had been instigated due to the woreening condition of the Malibu, Newhall :,: Simi Valley fires. Area G (South Bay) wee instructed to aesemble an 8 unit teak force at Inglewood by 100 p.m. and proceeddirectly into the Malibu Canyon Area. Due to our own limited manpower availability at that time (personnel on duty eonsisted of three regulars and two volunteers) Chief Smith was informed it would be impossible to release a unit from Hermosa. By Saturday morning another call had been received by Area G requesting ad-- ditiona] manpower and equS pment. Upon notification by Manhattan Beach that they were unable to send a second unit al] off duty Hermosa Personnel were placed on standby and Unit 702 (1961 Seagrave) was prepared to move out. At 11:00 a.m..Unit 702 under the :'ommond of Captain Banfield left Hermosa • enroute to the staging area then located at Los Angeles County Fire Station X70, Carbon Canyon Road and Pacific Coast Highway in Malibu. Upon its ar- rival it was immediately assigned to the fire scene in the Rambla Pacifico area. Plana sere then formulated for the relief crew on Sundt morning. The second orow ides under the oomznond of Captain Geonetta; they left with me in Unit 709 at 500 a..m. Sunday enroute to Inglewood: from there a ten car convoy pro- ceeded to Malibu and relief was made at the Rambla Pacific staging area. Two additional reliefs were made prior to final release of Unit 702. One at 7:00 p.m. Sunday evening and the last at ]:00 p.m. Monday afternoon, both in Los Flores Canyon approximate]y 5 miles north of Pacific Coast Highway. Unit 702 was relieved from the fire line Monday night and arrived back in the station at 11:33 p.m. Upon our arrival in Los Flores canyon Monday afternoon, preparations were under way to backfire an unburned area along the East side of the canyon. All available fire units and manpower were requested to remain in the area to prevent the fire from jumping the road to the west thereby endangering many more homes in the Rambla Pacifico Area. I remained on the fire line with Captain Banfield, Captain Geonetta end both relief crews until the operation was completed ;.t 6:30 p.m. To further compound the critical weekend firs problem, a Palos Verdes brash fire broke out Sunday night and again Monday morning. A, Mutual Aid Plan III was activated during both. fires which would ordinarily move a Hermosa Unit to Redondo headquarters. Due to a shortage of equipment throughout the South Bay this was modified and an El Segundo unit was tent to Hennosa thereby permitting a two company response to any location in the Beach area. Attached is the information on such a sign. Although costs vary with the type of hardware needed, the cost would be basically $64 per sign. Thus, for Pacific Coast Highway and Aviation, both directions, the total would run about $1,300. If the State would share, obviously our cost would be reduced. The windmill used to pump water to irri- gate the fields of Herman Vetter, a pio- neer flower grower. The land was recently subdivided, hut before an apartment house could be built on the site of the windmill, a group of citizens formed the Windmill Committee and set out. to save it. They had to sequin: the windmill, find a site for it, andraisefunds for moving and refurbishing it. The land 'developer donated the windmill. The committee persuaded the city coun- cil to make space for it in Greenwood Park, a triangle of greenery at Pa Coast Highway and Aviation Boulevard. Entirely through sales of limited -edition linoleum block prints donated by artist - Harold Grieve, the committee raised $730 for expenses, and finally Seabees from Terminal Island dismantled, moved, and erected the 30 -foot -tall structure. Then it was ready for dedication—at a fiesta in June. The windmill is now purely decorative; it still rotates in the breeze, but it's not connected to a. well pump. P r I 7 tl •
