FOR A CONDITIONAL USE PERMIT TO ESTABLISH A TAKE-OUT FOOD BUSINESS AT 1201 HERMOSA AVENUE, AS HEREINAFTER SET FORTH. WHEREAS, an application for a conditional use permit, signed by Roger Schwimmer, Vice President, Pioneer #30, Inc., been filed requesting a conditional use permit to establish food business at 1201 Hermosa Avenue; and WHEREAS, said application has been duly considered by the City Planning Commission at a hearing thereon as provided in Zoning Ordinance No. N. This memorandum obviously runs contrary to that subinitted by the Police Department, and that is understandable since their rientation properly is to takt, the side of caution and minimize risk. However, it seems to me that in this case the opportunity to create a much improved operational climate at this premises should be 'seriously considered, and I think over- comes the risk because I am persuaded of the applicantssincerity. McDaniel, City Manager SUBJECT: Storer C We T. V. --Ray Wilson Letter Gentlemen: Mr. Wilson, Storer C,bie T. V. , and the city have been going around in circles for several weeks now. Mr. Wilson's specific complaint iS that Storer destroyed his diChondra grass and plantings without per- mission and has failed to restore them to their original condition, and then that he sustained other damage to his property and interior rugs by tracking in mud or other material due to this condition. The fact of the matter is that the installation was made on city right of .wpy under Engineering Department approval, as have been all of the others, and that Storer has exercised more than the required amount of diligence in returning the grounds to their former state. However, all of Storr's efforts 'heve failed to conciliate Mr. Wilson, and he has evidently main- tained a vociferous line of communication with them. Storer has evidently now reached the position -Where they are fearful of doing more because it may lead to an admission of liability for any interior damage. In our opinion, Storer Cable T.
