(fa -tebT At request of Councilman Bigo, City Attorney interpreted composition of Planning Commission anCouncilniah Valdes requested that Section 2-73 of City Code be rewrittentto be consistent with current state statutes. 8. Councilman Post stated that he would be turning in a list of people suggested as members of the Beach Committee, and inviting interested citizens to volunteer. 9. At request of Councilman Post, City Manager outlined steps taken so far to deal with potential 4th of July problems. Police Department having meetings with Redondo Beach and Manhattan Beach, and staff getting ready. Councilman Valdes suggested special mailing re fact that fireworks are prohibited from use as well as sale within city; Council agreed thaliquor stores should be asked if they will stop sale of liquor at earlier hour on voluntary basis. 10. Non -Agenda - City Council: a. Councilman Wise requested information re status of validated parking in Lot "A" - requested attention to problem of delivery trucks not being able to get through narrow gate. _lam b. Councilman Valdes requested info re what city was doing about issuing business licenses to rental units and was informed that license department would be checkingwith building department. •c. Councilman Valdes suggested that nuisance abatement procedure be used re illegal rentals. d. Councilman Valdes read aloud memo from"YYoixth Advisory Council received and filed on consent calendar, advising of their belief that any individual regardless of personal or political beliefs should have right to serve in elective or appointive office. e. Actionp&etdiadjourn this meeting to an adjourned regular meeting to be held on Tuesday, June 12, 1973 at 7:30 p.m. to discuss the 1973-74 Budget, Hermosa, Beach Redevelopment Agency Project Area Committee and any other matters that might come up. Councilman Bigo requested opinion of City Attorney regarding possible conflict of interest as Councilman and member of Redevelopment Agency due to fact that he owns several pieces of property within project area. Special Counsel for Agency advises that Councilman Bigo should not participate in discussion or vote until after Redevelopment Plan is adopted. City Attorney feels strongly that it is duty of elected official to vote; however, the problem of perspnalo?liabila:tylcould not be overlooked. Both attorneys agreed that Councilman Bigo could participate in Agency matters on agenda tonight - but should not participate in discussion o:fprotest petitions on Council agenda. Councilman Bigo said that he would go along with advice re Redevelopment Project matters this date and wait for further advice from City Attorney re future actions. g. Councilman Wise requested advice re his stand opposing redevelop- ment project. Was told that he could not resign from Agency without resigning from Council; and that membership on agency precluded his investment in property within the survey area. Councilman Wise requested that City Attorney research results of his declaring himself absent from all Agency meetings, and stated that he would be "in absentia" until such• findings were determined. „,J City Council Redevelopment Agency - 6/5/73 -3- 11. to uphold the action of the Board of Zoning Adjustment granting a variance on property located at 409 Hopkins Avenue to build two single family residences. in an R-2 Zone in lieu of a single two- L0:✓family residence, as set forth in Resolution B.Z.A. 154-96, adopted April 2, 1973.
